RESPONSE 1

One element of a contract is the offer, which "...is a promise by one party to do (or not to do) something if the other party agrees to do (or not do) something" (Pozgar & Santucci, 2016, p. 127). This would need to be an official document to sign for the purchase of the CT scanner. Legal representation would be able to determine if a contract is valid. The next element of a contract is consideration, which "requires that each party to a contract give up something of value in exchange for something of value" (Pozgar & Santucci, 2016, p. 127). This is the exchange of a good for monetary compensation. The next element is acceptance of the offer, so the written, legal contract can be formed. The offer must include the components of a meeting, be definite and complete, and have a duration of acceptance (Pozgar & Santucci, 2016, pps. 127-128). For a new CT scanner, it would not be appropriate to sign a contract without a hospital team and legal department meeting to review.

Personally, the most important elements of the contract would be the completeness and duration. I would want to know the mechanisms for the CT scanner and what the contract would contain concerning mechanical failure or other equipment errors. I would also want to know how long the CT scanner would be expected to be in use and how the warranty would work. While these are detailed elements, details are important in contracts. The life expectancy of the equipment should be considered heavily when purchasing something like this, especially if it will be used frequently.
