1st peer post (Antwan)
1. The first Supreme Court Case I looked at was the Korematsu v. United States. This case is about the United States military forcing the Japanese Americans and Japanese residence into ‘camps” due to them being seen as a threat since the bombing of Pearl Harbor. The results of the first case was in favor of the military because they said it was not race based and not thinking the Japanese Americans a threat to the United States military. The case was reopened because later on there was evidence that the military destroyed evidence. The case was in favor of Korematsu and the other Japanese Americans because this was racially based action, which violates the 14th I learned that in the past, there was a lack of care for the public’s constitutional rights and that many actions were still based upon the race of a group with ill regard to the Constitutional rights.
2. The second case I looked at was the Trump v. Hawaii case of 2018. The current president has passed a travel ban against certain countries, which brought many to believe it was religiously based because the countries chosen were predominately Islamic religion. Hawaii and Dr.Elshikh filed a lawsuit against the president due to believing the travel ban was religiously based. The Supreme Court was in favor of the president Donald Trump because it falls under the executive power of the president. I learned that the Supreme Court being appointed by the president can be a disservice to the country because some cases that are against the president can be appeared as in favor of the president and not for ensuring that the cases were Constitutional.

The early 1970s Roe v. Wade case is that which established abortion as legal and a part of the 14th amendment. The ruling was 7-2 and the Court felt that the right to an abortion fell under a woman’s right to medical privacy (Griswold v. Connecticut). Women were also able to have an abortion at different trimesters of the pregnancy. The ruling affected 46 states. I believe that the significance of this case is coming back into play at this time in history because we have many people who are trying to get rid of a woman’s right to an abortion. This brings back the argument of why are men choosing what to do with a woman’s body and why are we allowing that? The anti-abortion bills are scary because there are many instances where abortions are necessary and can even be fatal if not received. It is unfortunate to live in a society where someone who does not even have the ability to bear a child is making laws about that.
The next case is Obergefell v. Hodges from 2015. This case is responsible for making same-sex marriage legal in the United States. It was 5-4 ruling. Before 2015, it was a state decision of whether it is legal or not. Because marriage is a fundamental part of the Constitution, people’s rights were being infringed. Granting couples of the same sex the ability to get married is granting them equal dignity under the law. This is important because there is literally no reason why people should not be allowed to marry someone from the same gender. Taking away that dignity or pursuit of happiness from someone is unconstitutional, and that is exactly why it is legal now.
