Subject: Concern of Payment of Completed Work
Dear Sir,
I am writing you to clarify whether you have been paid yet for the concrete work we have submitted payment for. It’s been over 60 days since we last got paid and our worry has been heighten. We anticipate payment in a timely matter and we can not operate our business at the rate we are getting paid at. We have followed all contract guidelines and steps to fulfill our promise to complete work as stated by contract documents. We sadly and painfully have to undergo legal procedures for this matter. As stated in stature 32-1129.04, we have the regretful right to suspend and/or terminate our performance per contractual obligations. Stature 32-1129.04 states and clarifies that right further:
· Subsection B: “A subcontractor may suspend performance under a construction contract or terminate a construction contract if the owner fails to make timely payment of amounts certified and approved pursuant to section 32-1129.01.”
· Subsect. B: “A subcontractor shall provide written notice to the contractor and owner at least three calendar days before the subcontractor's intended suspension or termination…”
· Subsection E: “A contractor or subcontractor that suspends performance as provided in this section is not required to furnish further labor, materials or services until the contractor or subcontractor is paid the amount that was certified and approved.”
