ABC Construction Co. has two job openings for which they are actively recruiting. They are hiring for a clerical position and a construction worker.

Scenario #1:

Mary applies for ABC Construction Co.’s clerical position. The job description includes duties of answering phones, typing memos, and attending meetings. Ten years ago, Mary suffered an automobile accident which left her lower extremities paralyzed. Here upper extremities, however, are fully functioning. She had a successful first interview and is called by the hiring manager for a final interview. After leaving the in-person interview with the hiring manager, Mary feels very confident she “nailed” that interview and will be selected as the “candidate of choice.” Mary receives a phone call by the hiring manager and is told that she will not be hired because of her disability which will prevent her from doing this type of job.

Mary feels discriminated against by not being hired and sues ABC Construction Co. for violations of the American with Disabilities Act of 1990.

Scenario #2:

Sam applies for ABC Construction Co.’s construction worker position. The job description entails building skyscrapers in Downtown Metropolis. Sam, who is blind, has an initial phone interview. At the end of the interview, the company states the next part of the interview process is performance based working on an existing skyscraper under construction. Sam then discloses his disability. The company then tells Sam he cannot be offered the second interview because of his disability. 

Sam is furious and feels discriminated against by not being hired. He sues ABC Construction Co. for violations of the American with Disabilities Act of 1990.

Based on both scenarios, please address whether Mary and Sam have a legitimate lawsuit and why. Important Note: Both scenarios have different outcomes. In providing your answers, please address the distinctions between the two scenarios and why they would have different results.

3. Your submissions should be submitted in Microsoft Word (.doc) via the assignment dropbox in D2L. 

4. This font type should be 12 pt type.

5. All submissions must abide by APA version 7 for formatting and style. The Purdue Owl site is a good source and reference.
