Good evening, first of all I want to thank you for coming to mediation. My name is Pedro Aguirre and you can call me Pedro. These two parties have decided to give a mediation a try by participated in the process the way we are going to begin today. Are all of you comfortable using you first name? Or how would you like me to address? I like to emphasize I haven't met with any one of you. I am going to tell you little bit about what mediation is and then we will start the actual mediation, so a mediation is the opportunity for the two of you to work through your differences by talking about it with the help of a neutral party which is a mediator.

It’s the mediator job to help you talk and reach an agreement we do not tell you what to do we do not judge and decided who’s right and wrong nor do I give you any advices so what comes out of this today is up to you if you do reach an agreement will be you who decide what the agreement looks like and this process is voluntary if you reach at one point where you feel that the meditation is not working and you wish to end it you may do so and similarly, I as meditator have the opportunity to end the mediation at any time. The way we begin the process is, I will begin by meeting the two of you together and the if I think will be helpful, I will be meeting with each of you separately. Everything said in meditation is confidential in case you need to go to court, I cannot be called to testify. Also, when I met each of you separately is confidential but is up to you whether would you like to share the information with the other party at any time.

The payment method for the meditator service would be pay at the end of this section and would be split equally. I would like to establish a couple of ground rules just some basic ones try to use some respectful languages and try to speak one at time I understand some of the things said here maybe upsetting you an might trigger you to react please maintain calm and if it not you turn I ask you to take some notes. I do want to hear some questions from you please feel free to ask question during the process. I want everyone want to have a chance to say what they need to say during the mediation process in respectful way. Its very important to keep in an open mind to generated as many ideas possible to the best solution. Now I would ask everyone to sign an agreement to participated in mediation which cover some of the things that I just explain, but also is relevant to Texas law about confidentiality if you want to have a quick read over and then sign on it as I meditator I sing this too. If there specific clause in case I need to follow with you please address those know before signing the agreement. At the mean time if you need to go the restroom there are down the hallway to the left. Also, there is water and coffee in the table in case one of you need to take a break or need to take medicine please let us know as soon as possible to accommodate the time. The person who contact the program typically goes first. I would start we the manager.

Inconclusion, both parties come into an agreement by generating multiple solution during the process that would benefit both of them. As a mediator job was to listen to both side and not be bias towards one party over other. It was important to be very active listing and not be judgmental during this process to have the best possible outcome for both parties. Nevertheless, a meditator job is to help people to find a solution by creating a common ground to both parties to start having a solitiom to their conflict.
