Purpose

The purpose of this project is to research and analyze ABA Model Rules of Profesional Conduct  and ABA Model Guidelines for Utilization of Paralegal Services and their application to paralegal roles and responsibilities.   The purpose is also to synthesize information and communicate effectively in writing.

Outcomes Met by Final Project:

· identify ethical problems raised by the applicable rules of professional conduct

· recommend appropriate conduct to avoid and resolve legal ethical problems

· apply ethical rules and interpretations to legal ethical issues

Instructions

General Instructions:

1.  Please do not use references to cases or case law in the project.

2.  DO not use quotes for any resources/rules:  summarize, paraphrase and cite.

3.  Use only resources assigned in the course in any of the 8 weeks.  These are all the resources you will need.   Using internet resources will be time consuming and many legal resources on the internet are misleading and/or inaccurate - thus, we will  not use them for this project.

4.   The law is very precise and legal issues are very focused, thus, the issues discussed in the project should be precise and focused - but in depth, substantive, specific and detailed, comprehensive.    All conclusions/opinions should be specifically supported/explained in detail ( refer to the module in Content re:  Supporting Positions/Arguments ).   Make sure all information/conclusions are directly relevant. 

5.  The project should begin with an introductory paragraph ( refer to the module in Content re:  Introductory Paragraphs and Sentences ).

6.  The project should end with a conclusion ( refer to the module in Content re:  Concluding Paragraphs and Sentences ). 

Specific Instructions for Project Content: 

Part I:  ABA Model Rules of Professional Conduct

 

Choose one (1) Rule that applies to attorneys that you believe is most important and relevant to, and has most significant implications for, paralegals and their typical roles/job responsibilities.  (You are not limited to Rules discussed in class.)

 

A.  List the number and title of the Rule.

 

B.  Evaluate and explain why you believe the rule is most important and significant for paralegals and their typical roles/responsibilities. (MINIMUM 2-3 paragraphs)

 

C.  Evaluate and explain 2-3 actions/examples of conduct of a paralegal that could potentially  contribute to violation of the rule identified in A. above (MINIMUM 2 paragraphs)

 tip:  this can be in the form of a scenario or simply an example discussed/explained in detail

D.  Evaluate and explain at least 3 things any paralegal can do to help ensure that the rule identified in A. above is not violated. (MINIMUM 3 paragraphs) 

tip:  this should be examples discussed/explained, NOT a specific scenario 

Part II.  ABA Model Guidelines for Utilization of Paralegal Services

 

Choose one (1) Guideline that applies to use of paralegals in the legal profession that you believe is most important and significant for paralegals and their typical roles/job responsibilities.  (You are not limited to Guidelines discussed in class.)

 

A.  List the number and title of the Guideline.

 

B.  Evaluate and explain why you believe the Guideline identified in A. above is most important and significant for paralegals and their typical roles/responsibilities. (MINIMUM 2-3 paragraphs)

 

C.  Evaluate and explain 2-3 actions/examples of conduct of a paralegal that could potentially contribute to violation of the Guideline identified in A. above.   (MINIMUM 2 paragraphs)

References should include relevant material from the ABA Model Rule Comments, the ABA Guidelines for Utilization of Paralegals and associated commentary and any assigned materials in Overview and Instructor Notes for weeks 1-8.  If you want to use any resources from the internet, please check to have them approved first.   

Support all conclusions in detail, specifically, in depth, and with reference to relevant assigned course materials.

Use in-text citations in the narrative for all reverence work, and full citation on a separate Resources page.

Use in-text citations AND References.  Only resources cited in the text can be included in References.  Do not use quotes.

Use correct, complete sentences in paragraph format.
