ASSIGNMENT 1 - RESEARCH ESSAY

There are two (2) questions worth 15 and 5 marks each.

You have listened to the first lecture of LAW205 Commercial and Corporate Law for Accountants and decided to register your own Pty Ltd company. You really like the idea of a company being a ‘separate legal identity’.

Required:

1. What is the “corporate veil” and under what circumstances is an Australian court likely to lift it? (15 marks)

Important: Answers must refer to relevant legislation and case law. This is a research assignment, additional research is required in addition to your textbook materials. Citation of the most recent court cases on the subject is encourages.

2. Download the necessary registration form from the ASIC website. Complete it for the registration of your company. This portion of the assignment is marked on the basis that all relevant fields of the form are filled in with the correct information. (5 marks)
