If you are the youtuber, under the Copyright Law, what do you concern about the Copyright Law?
- The content is protected under the Copyright Law.
- The author (youtuber) is the owner if such content, however; according to the Thailand Copyright Act, a work is recognized as copyrighted from the moment it is created. Recordation of a copyright at the Copyright Office is still recommended as the record will be important evidence of the author's ownership in the event of a dispute.
- Under the Copyright Law, the author has the exclusive rights of:
(1) reproduction or adaptation;
(2) communication to public;
(3) letting for hire of the original or the copies of a computer program, an audiovisual work, a cinematographic work and a sound recording;
(4) giving benefits accruing from the copyright to other persons;
(5) licensing the rights mentioned in (1), (2) or (3) with or without conditions, provided that the said conditions shall not unfairly restrict the competition.
Whether the conditions as mentioned in sub-section (5) of paragraph one are unfair restrictions of competition or not shall be considered in accordance with the rules, methods and conditions set forth in the Ministerial Regulation
- copyright by virtue of this Act endures for the life of the author and fifty years after the death of the author.
The income as receives from YouTube, it is considered as an income in category 8 for the personal income tax purpose.
