LAW Guilty plea

In relation to penalty it is submitted that the offender has limited antecedents in respect of firearm type offences, these are limited to:

a) 10 May 2006 – use unauthorised firearm Fine: $200

b) 9 October 2018 - possess ammunition w/o permit Fine: $2,000

The offender was arrested and bail refused on 3 January 2020. Mr Smith has been remanded in custody since this time.

The total time served referable to these offences is 6 months, 3 days.

It is submitted that, taking into account the time already served by Mr Smith, it is submitted that it would be appropriate to deal with this matter by way of a Community Corrections Order pursuant to Crimes (Sentencing Procedure) Act 1999 (NSW) s 8.

In the alternative, it is submitted that it would be appropriate to deal with this matter by way of an Intensive Correction Order pursuant to Crimes (Sentencing Procedure) Act 1999 (NSW) s 7.
