In the year 2009, there was a young child who was born having multiple medical concerns. Generally, none of them was considered life-threatening; however, there were complicated medically. This child was born with a leak within his esophagus. The child, who was six years old, was left with a severe brain injury that was mainly irreparable and cerebral palsy due to multiple surgeries that Dr. Mark Holterman performed. Later on, it was discovered that the doctor was using surgical techniques that had not been approved for the appropriate treatment of the leak within the child's esophagus. On top of the twenty-five surgeries and the utilization of inappropriate techniques and the devices that continuously placed the child's safety at risk. The culmination of the given risks resulted in the child's pulmonary artery getting punctured and leading to a harm that is permanent when Dr. Holterman utilized a suturing device in an attempt to have the esophagus repaired (Nguyen et al., 2022)
The clinician factors played a considerable role in the damage suffered by Dr. Holterman's hands. His lack of suitable clinical judgment and procedural skills contributed to the harm inflicted on the child. I believe that there happened to be administrative factors that also contributed to harming the child. Administrative controls should have been implemented to monitor the number of surgeries and the techniques employed on the child patient, mainly because of the child's tender age (Holtermann et al., 2021, March).
I also believe that the hospital had the same share of negligence. In my perception, the hospital was more detailed with the money survey generated due to these given surgeries. In my observations, I have noticed that within todays healthcare, there tends to be a lesser focus placed on the patient and patient safety compared to the focus on the agency's profitability. It is a reality that has resulted in preventable infections within the hospitals in addition to lack of appropriate background checks on the medical providers getting hired and ones having issues in their past. This reality might be changed in various ways, one of them being starting to hold the providers accountable financially with fines and penalties, as per my perception. This acts as a deterrent within most situations.
YOU DID NOT ANSWERE THIS TWO QUESTIONS
1. Provide specific details of the case as to which law and whether it was tried in criminal or civil court.
2. Sort out the legal system violation from the penalty. What penalties did occur and what penalties may have occurred but were not written in the article.
