Question
Emma needs a new television and she goes to a shop owned by Tony. Emma browses for a while and a widescreen television caught her eye.
Attached to the television (TV) screen was a sign that reads:
One Day Offer! Was $3,000.
Now only $1,999.
Emma speaks to the shop owner, Tony.
Emma: “Hello! I see you are offering this TV for sale for $1,999. Can you make it cheaper? How about $1,500?”
Tony: “Sorry the item is already on sale, I can’t make much profit selling it at $1,500.”
Emma: “How about $1,800?”
Tony: “Sorry, I am unable to sell at that price. My best price is $1,900.”
Emma: “I need to think about this.”
Tony: “$1,900 is the lowest we can sell this TV. I have limited stock and this offer will end at 5pm today.”
The next day, Emma went back to the shop and speaks to Tony.
Emma: “I am happy to pay $1,900 for the TV we spoke about yesterday.”
Tony: “I am really sorry, that TV is now selling for $3,000.”
Advise Emma whether there is a contract between Tony and Emma under contract law.
In your answer, you must consider and apply any relevant decisions from cases you have studied.
