FACT PATTERN PREPARATION WILL

Client John Smith makes an appointment with the firm that you are working to make

a will.

He tells you and the attorney the following facts: He has three children John Smith Jr

age 19, Christopher Smith age 16 and Jane Smith age 12. He wants his 3 children to

inherit his property in equal shares and that if any of them die before him that their

children if they have any inherit their child’s share.

He also wants to give a gift of $1,000 to United Way and his diamond ring to his son

Christopher.

He wants to appoint his sister Janice Thomas guardian of the minor children for their

person and for their property.

He wants his brother Thomas Smith to be his personal representative and sister Janice

Thomas to be his alternative personal representative should his brother fail to or be

unable to do so.

Please prepare a will with the sample I sent you and refer to your book for language

the you need regarding the disposition of property or anything else.
