The following list contains information pertaining to the incident related to the crane and scaffolding load. (Note

this information is fictional and any resemblance to real people companies etc. is coincidental):

• The construction underway is called “Trinity Towers”

• Hospital report – Dave Smith has woken from his coma, he made a brief statement; “I remember being

on the back of the truck with Yan then the truck driver yelling something out to me as the load was

lifted, and then getting hit by something and getting crushed.”

• The following information relates to training and induction records:

o Dave Smith – current NSW “White Card” Construction Induction Card and Riggers certificate,

completed work site induction.

o Yan Chan – current NSW “White Card” Construction Induction Card, no riggers certificate,

completed work site induction.

o Juan Garciella – current NSW “White Card” Construction Induction Card, no written evidence that

he has completed a work site induction, though there are two witnesses who claim he did attend

an induction session with them. Holds all the relevant current crane operator certifications.

o Duncan Jones - current NSW “White Card” Construction Induction Card, completed work site

• The following information relates to risk assessments (RA) and safe work method statements (SWMS):

o General rigging operations – RA exists and is current, SWMS exists and is current, specifically

describes rigging for crane lifting procedures and communication protocols, though in a minimal

way

o General crane lifting operations – RA exists and is current, SWMS exists and is current, specifically

describes crane/ground communication processes and is reasonably thorough

o Operation of jack hammers – RA exists and is current, SWMS exists and review date has expired.

Specifically describes use of hearing and eye PPE

o General excavations – RA and SWMS exist and are both current, specifically mentions dust as a

hazard and controls including keeping the area wet to minimise dust generated
