Discrimination in Employment

Each student will select a case from the ILR 622 Cases in Employment Discrimination book. It is located in this week’s course materials as a .pdf file in two parts. The cases appear on pages 93-135. The assignment is to prepare a written analysis of the selected case following the Directions on page 4 and using the format detailed on pages 3-7 . You may select any of the cases, however if you choose one involving materials covered later in the course, e.g., the ADA, the standards I apply in grading your work will not be any different than if the material was already covered.

Examples of successful papers submitted by previous students appear on pages 10-63. Do not be intimidated by the length of these papers. What you must do is to address each of the elements detailed in the Directions on page 4. What is important is the quality of your analysis rather than the volume you produce. If you are able to address each of these elements in a manner that results in a shorter paper, that is not a problem as long as your brevity hasn’t compromised the quality of your analysis. The points assigned to each element on Page 4 are a general guide as to the relative weight each element is worth in your overall grade for the assignment. This means you should devote a significantly larger portion of the paper to “the Complainant's best Theory of the Case” than you should to identifying “the type or category of discrimination.” The assignment is worth 20% of your course grade, as outlined in the syllabus.
