INTRODUCTION

The main reason as to why the parents take their children to school is they should be provided with quality education and this should be provided under safe,secure and peacefull environment in order for the to learn.A great responsibility of the parents to keep their children safe at home,the challenge becomes of even more critical when they take their children to school.is due to the fear that their children may be bulled or harassed.

This goes further to where the some parents also fear that their children privacy or the right to speech can be undermined while they are at school.This makes the parents to have a great concern of their children during the school hours as to whether the school is providing the appropriate measures of safely and even if there is adequate measures that the school has taken in order to provide solid school discipline policy in place.On the other hand other parents are deeply in the interest of the children lunchbox and other school-related items are with standard of the school.

The parents,educators and guardians despite their concerns they should be aware of some of the legal issues and laws pertaining to the school safety,these include the following bullying,premises liability at school,first amendment concerns,student code of conduct/discipline policies and school related product of safety.

These are the most crucial legal issues that any child who has stepped in a school has come incontact with them in one way or the other.The schools try their maximum best to be able to prevent these occurances at school.

Premises Liability at Schools

Due to the high number of cases that have being as a result of some schools being enable to keep the measures to provide maximum level of the students’ safety while they are at the school property.

According to the theory of “premises liability”it states that the occupiers and owners of the land are required to keep the premises safe for those that are legally required to be there,a school as a premises is included in this.

A more concern should taken to the schools because is a place occupied with young people which are the students.The children that when at school they fall sick,those bullied or injuried and those that face harassment and the school has not taken any help or aid to the children,the parents of these children have the legal right to file a claim against the for not keeping the premises of the school safe.

An example of premises liability at schools is where the P.E teacher had the students jump over piled-up mats, during the exercise the mats dislodged making it dangerous.The teacher didn’t take any action to stop the exercise or return the mats back in place,Susies who was trying to jump over the dislodged mats held her leg and she fell and injured her vertebrae,it simply indicate this was not an accident hence the school was held responsible.

Bullying in Schools

Bullying is experienced in all learning institutions that is starting from primary,secondary,colleges and campuses.This practice is very crucial in that it does not only interfare with the overall learning goals of educational environments but also it is a obstacles that affects the student’s right of attending classes on the institutions that are safe.

The children who are bullied or harassed,their parents have the right to claim the school responsible for not keeping in place the right measures to stop harmful behavior.Some of the mechanism that can used to stop this act are like,suspension of the students who bully others and an extension of expelling them if they are a nuisance.

The schools can also deploy by enforcing codes of conduct that typically addresses variety type of behaviors in order to reduce this type of act.Some states have passed anti-bullying laws i.e Carlifornia,Colorado and Arkansas with the aim of making schools safe.In federal government also has a great influence in this that it has set First Amendment and Establishment Clause.

School-Related Product Safety

Despite the need of various items by the students to conduct their studies,an important point should be considered if whether these items are of any form of harm to the students.Items such as clothings with drawstrings,BPA-lined plastic containers and non-insulated lunchbox are considered to cause risks to the students.These items are rejected in country such as the US.

First Amendment Concerns

Right of speech is a mojar right that the students should be allows to practice,even though the government keeps a lot of emphasis to this right it can be also restricted.This is mostly experienced in the public schools where several cases of free speech lawsuit have been reported.The court has ruled out some speeches such as wearing of certain clothing and religious symbols and participating in groups should be of the intension of balancing the student right of speech.

School Codes of Conduct/Discipline policies

In every learning institution there are student code of conduct and discipline policies that clearly indicates the student’s rights and responsibility within the school.They also indicate those practices that are acceptable and those inappropriate.

CONCLUSION

Despite the importance of the learning processes in schools,the safety of the student is also kept at top of the list because it not only for their security purpose but it also enables them in the learning growth as well. Hence parents,educators and guardians are supposed to seek these measures in schools for the benefit of their children.
