Should same-sex marriage be legalized in China

Summary of student’s ethical perspective on the issue:

Law should reflect the will of the people. In China today, laws are formulated and approved by the National People's Congress and its Standing Committee. Legislative bodies are essentially the embodiment of the will of the people. In today's China, we can't see any soil sufficient to promote the legalization of same-sex marriage. If it is not possible to prove the scale and inclusiveness of the people's will at present, then any legislation that transcends the people's will is dangerous.

Ethical theory or theories I will use to support arguments in the essay

Utilitarianism: If a same-sex marriage produces the best net benefit, then it is morally right. The benefit principle requires a measure of the potential harm and benefit of sexual activity.
