Research whether there was a contract and discuss the UETA provisions concerning the meaning and records of signatures.

            The Uniform Electronic Transactions Act (UETA) gives a guarantee that the electronic transactions are just as enforceable as the transactions recorded on the paper. The act stipulates that a contract cannot be denied legal effect or the enforceability just because the means of formation used in the establishment of the contract is not electronic records (Miller, 2014). It also depicts that any law which requires having a physical record will be satisfied through an electronic record and any signature required can be met through the use of an electronic signature. The rule focuses on the electronic records and the involved electronic signatures relating to the specific transactions. There was a contract between Candie Cardware and Delilah because, when Candie Cardware issued the offer, Delilah accepted it by sending an email to the company to show interest in the offer and his willingness to pay for it.

            It is clear that the above facts place the issue within the jurisdiction of the UETA. One of the reasons behind this is the fact that the rules outlined are for the electronic records and the electronic signatures which relate to the transactions made online. The law applies to the business to business e-commerce users who take part in the electronic purchases and they can be held liable for their actions in the transaction process. The individuals involved also have legal recourse in case things do go wrong. UETA occurs only in the cases where two people have agreed to conduct business electronically and from the case, it is clear that the Candie Cardware and Delilah had agreed to do this since, in the ad, the company had indicated that interested parties should get back through the email and Delilah did the same showing that they were all ready to conduct the transactions electronically.
