Philosophical Orientations and Theories of Corrections

The biological factors that contributed to Jimmy’s criminal behavior would be the fact

that he was raised in a one parent home and had no idea where his mother could be along with

the drug uses. The psychological factors that contributed is the abuse that he suffered mentally

and physically also the fact that since being child he experiences mental disorders like antisocial

personality and bipolar disorder.

The theories that might account for the offender’s behavior that I would say during

reading I believe that Jimmy will fit in the strain theory. The theory states that because a person

will not obtain the goals to be successful and because of this they feel strain (Hanser, 2017).

Jimmy fit this because he is already kicked of public schools which probably left with the

thought that he will probably not be going to college or trade school and he also do not have any

encouragement from his father his is always putting him down. I would also say that his

environment contributes to this also with him living in a poverty area that is crime ridden.

The mitigating factors I would consider when deciding on sentencing is that I would have

to consider the background of Jimmy he comes from a single-family home where he is being

raised by his father who has been regularly abusing Jimmy mentally and physically which has

been going on since he was a child. Jimmy self-medicates himself by abusing drugs he has

recently been diagnosed with mental issues and has no clue of where his mother is. Jimmy also

displays violent outburst which has cause him to be kick out of school because of fighting.

The aggravating circumstance that I would have to consider as well would be the fact

that Jimmy was involved with stealing a vehicle and then after stealing the vehicle Jimmy and

his friend decided to do drugs which cause them to become beyond intoxicated to the point

where they had no clue, what was going on and during this Jimmy was driving the stolen car and

due to him being inebriated he had lost control of the car and caused the death of two

passengers of car that he hit head on.

Sentencing for Jimmy will be done in a two-stage process after he is found guilty or

convicted of the crime that he committed (Hanser, 2017). I would recommend that there be no

probation because Jimmy would continue to use drugs and then will most likely end up in the

same circumstance again. Incarceration will be the choice due to the seriousness and nature

of the crime. I do believe that Jimmy is rehabilitative because everything came down to the drug

use which I believe he was using as a way of treating the abuse that he has suffered at the hand

of his father. Since there is mention of criminal history this will have to be considered when it

comes to the recommendation of sentencing (Hanser, 2017)

The type of sanctions that I would recommend for Jimmy is will definitely be

imprisonment and the reason that I would recommend this is because in the commission of the

crime of stealing a car Jimmy lost control and caused the death of two innocent passengers. In

Florida this will be 782.071 Vehicular homicide because of the break he was found in town was

picked up by the police and instead of taken to jail he was transported to the hospital who

diagnosed him.

I think that if Jimmy is returned to the same environment after completing his sentence

the chances are very high for him to reoffend again. I think that Jimmy will need to not only

have mental health counseling while he is incarcerated, he will need to be able to have access to

where that he could possibly complete school and not just complete but have the chance to either

get to learning a trade to prepare him for when he may be released to achieve the best result for

Jimmy is to use reintegration. Reintegration focus for the offender is to have the offender reinter

society and be connected in area that will be gainful as well as productive for Jimmy (Hanser,

2017).

I have saw people that I know that spent a long time in prison and while and they came

something that was similar to Jimmy, but while in there learn a trade and once, they were

released got out and put the trade to work and now one has a successful air conditioning

company and the other have a successful construction business and both people actually now

have crews that work for them it is possible if given the right opportunity a person could change

and be rehabbed.
