Question 1;
Answer:
The criminal behavior that interests me is forcible rape. Rape is a massive issue of today’s world. This crime is common in almost every country. It’s not specified to one place or race. Rapes are being committed on daily basis in different parts of the world and many of the cases are never reported to the police. That is why it is known to be the most underreported offence. The victims fear to report the crime because there are many stigmas attached to it. It becomes very difficult for the victim to survive in the society. It is a hard task to prove rape as it demands physical signs and evidences. Its difficult to provide enough evidences to prove rape. Rape has nothing to do with someone’s financial status, age or race.
The typical perpetrator of this crime is male gender. Rape is forcefully harassing someone to have sexual contact with him. Rape is against the will of the victim. As far as the race is concerned, this crime has nothing to do with it. The whole world is suffering from it. Each and every country has such offenders. So it literally has nothing to do with race. It totally depends on the mental and psychological behavior of the criminal. The typical age to be noticed for this crime is between teenagers to adulthood like 15-40 years old males. Almost all the criminals of such crime fall under this age. The socioeconomic status plays a vital role in building up such heinous criminals. Mostly criminals belong to families that are broken or have some issues. The desperation in every society is increasing day by day and it is resulting in increasing this crime rate. Some important factors that play a vital role in perusing the criminals to commit such monstrous crime is pure nudity on television and vulgarity shown in movies and shows.
Civil and criminal legal systems are different in many ways. In criminal legal system offence done is known as crime while in civil legal system the offence is known as tort. The criminal offence is against the whole society and the state. While civil crimes are against individuals. In criminal system state provide the lawyer to the prosecution while In civil, the prosecution hires an attorney. The penalties in both the systems differ. In criminal cases incarceration/imprisonment, fines and forfeitures, probation, community services, and sometimes restitution to the individual victim are the penalties. While in civil legal system penalties include fines and damages by the defendant.
Question 2:
Answer:
Causes of the rape:
There are different behaviors that lead to this disgusting crime. Some of the reasons that lead to this criminal behavior are;
· Rape occurs when male thinks that they can dominate females. They think they have all the rights over them. They misjudge the definition of right and are attracted towards such crime.
· The prevailing sexist ethos in western society is another cause of this criminal behavior.
· The massive amount of increased desperation in the society causes rape. This desperation is caused by the media and society in many ways.
· Nudity and vulgarity in movies and TV shows is one of the most important factors in increasing this crime.
· As it is a hard job to prove this crime and many of the crimes are never reported. So criminals have no fear to get caught hence committing it openly.
There are many socio biological and psychological theories related to this crime. There are multi factor psychological theories and micro level psychological theories’. Both these theories include sexual violence and abuse. These theories include how and why the crime or offender committed a crime. What was his mental state in which he commits the crime. How is his behavior and relationship with the society. Psychological theories include the criminal’s need and desperation to go for such crime. Malamuth constructed a theory in 1996 known to be multi factor theory. This theory was subject to refinements and numerous appraisals. In this theory socio cultural feminist perspectives are being analyzed. This theory shows the sexual aggression of males and reason behind it.
Question 3:
Answer:
Criminal system deals with the behavior that is against the society while civil system is against an individual or a corporation. Some examples of criminal offences are murders, assault, theft, rape etc. While civil crimes include negligence, defamation, and breach of contract etc.
In criminal cases, case is initiated by federal government while in civil cases; a private party initiates a case and is the judgment is given by judge.
Prominently, because a solitary illegal act may comprise both a public felony and a private injury, it may ascend to both criminal and civil offences. An extensively cited case is that of the earlier American football player O.J. Simpson: in 1996 he was guilty of having killed his wife and her friend, but two years afterward he was found accountable for their murder in a civil case for unlawful death.
