Inadequate labor laws among domestic workers in the United States of America continue to be a major legislative challenge. According to a Center for American Progress survey, around 2.5 million domestic workers in the United States are still subjected to discrimination, sexual harassment, and economic exploitation. These problems are exacerbated in the absence of legislation to protect people from their situation under federal and state protection laws. In an article in The Guardian Magazine, Falconer and Annie show that because they work indoors, this form of exploitation is made possible because their jobs are not very visible to onlookers. Many of these workers are immigrants from other countries or low-income areas, and many are unaware of their rights and how they should be handled. That feature has made working conditions tough for them because of legislative flaws.
Can we attribute the condition of domestic workers in the country because of the inadequacies in legislation? I believe the mantle is not solely on the government, but on the employers and the workers themselves. The employers of these domestic workers have failed to act with utmost humanity towards protecting these domestic workers by offering contracts that protect their interests in Human Rights Watch. For example, it is not right for parents to mistreat their domestic workers, who are also parents in their ways. Second, I believe that domestic workers have failed to have policies that can protect them from exploitation. For example, they can develop a system whereby their organizations can set up clear contracting guidelines to govern their work. These contractual guidelines are likely to form an integral part in ensuring that the conduct of the employers is in the interest of the workers rather than of the employing agencies.
