Construction Law Cases

The two cases selected should involve different:

· contract issues

· construction project

· a contractor and/or project owner

For each case, read the article and analyze the situation in view of the subject matter and contract issues discussed in class.

 

For each of the two court cases:

· Provide the case number and title for each case

· Indicate Parties involved (Plaintiff, defendant, Contractor, Owner, Designer, etc.)

· Project Name, Type, Contract Amount, Location of project

· Provide Date and Location of the case/court

· Brief summary of the case

· Court decision and/or award given

· Further action(s) by the Parties, if any

Commentary:

(a) Provide your opinion of the case.

(b) Define/describe/explain contract issues involved.

(c) Prior actions/arrangements, the parties should have taken/made to settle the

case before it went to court.

(d) What could have been done by whom in the past (or what could be done in the future) to avoid problems of this nature?
