What argument would you use, for or against a decision by the employer in this case to insist on expanding the drug program to include prohibition of the sale, possession, or use of illegal substances on the employee’s own time? Support your answer.
In reviewing this case, I side with union and the employee’s right to privacy. The following excerpt is regarding an employee’s right to privacy and employers increasingly intruding into their employee’s personal lives.
“Drug testing allows employers to intrude upon the private lives of their employees. The ‘right to be left alone" is, in the words of the late Supreme Court Justice Louis Brandeis, ‘the most comprehensive of rights and the right most valued by civilized men’ (ALCU)".
As stated in the case, the employee was penalized for not coming into work on a day his crew was working (Cavell and Heavrin, 2013). However, he was called in to do a drug test on his day off- which no known precautions are mentioned. Employees can opt to not take a drug test, but run the risk of being fired for failure to take the drug test (Guerin, 2019).
It is rather unusual to call an employee into work on their day off, not to work, but to take a drug test. An employee has the right to privacy, which was violated by having to undergo drug testing on a day off. Off-duty is the concept of the employee not having any company responsibilities. The employee in question was off duty (no company requirements) and still asked to undergo drug testing in his personal time. By requiring an employee to essentially “be on call” for three years is unreasonable and the employee is also not paid a higher rate for being “on call” 24/7.

I realize that I am probably going to be in the minority here.
With that said, a decision made by the employer to insist on expanding the drug program to include prohibition of the sale, possession, or use of illegal substances on the employee's own time is an infringement on employees' personal time and private lives. If an employee shows up to work, performs the work consistently and the use of the substance while not at work brings little or no issue to the workplace, then it should not be a concern. Excessive alcohol use led to approximately 88,000 deaths and 2.5 million years of potential life lost each year in the United States from 2006 – 2010 (“CDC - Fact Sheets-Alcohol Use And Health - Alcohol,” n.d.). Yet, alcohol is still legal. What people do in the privacy of their own homes should remain just that--private. Only when the substance use poses an issue in the workplace, should it be addressed.
In addition, procuring a substance (such as an antidepressant, ADHD medication or something for anxiety) outside of a doctor's office or pharmacy would also be considered illegal. But if the substance helps the employee perform his or her work, is it a bother to the other employees? Does it interrupt the work being done? An employer pays the employee to come into work and perform the duties of the job. What sense is it that a company can drug test you and punish you for what you do in your own personal time if it's not affecting your productivity and output? I've worked with some very creative people who smoke illegal substances and can still pass drug tests. Users of CBD for chronic pain fail drug tests because there may be THC present. Poppy seeds still throw drug tests for opioid use.
Also, if an employee feels the need to sell illegal substances on his or her own time, then the company needs to look at raising wages.
If--in fact-- "there is no intent to intrude upon the private lives of employees"... don't.
