CEE 3311 - CONSTRUCTION ENGINEERING
TERM PAPER ON CONSTRUCTION CONTRACT COURT CASES
Due Date: Friday, March 1, 2019 • Each student shall select two construction-related court cases from a magazine, journal, or
website on Internet. Two students cannot select the same court case(s). The two cases selected should involve different contract issues; construction project; a contractor and/or project owner. For each case, read the article and analyze the situation in view of the subject matter and contract issues discussed in class.
• Prepare a comprehensive type-written report, using double-spaced, 1" margins throughout, with
page numbers, giving the following points for each of the two court cases:
(1) Provide the case number and title for each case (2) Indicate Parties involved (Plaintiff, defendant, Contractor, Owner, Designer, etc.) (3) Project Name, Type, Contract Amount, Location of project (4) Provide Date and Location of the case/court (5) Brief summary of the case (6) Court decision and/or award given (7) Further action(s) by the Parties, if any (8) Commentary:
(a) Provide your opinion of the case. (b) Define/describe/explain contract issues involved. (c) Prior actions/arrangements, the parties should have taken/made to settle the
case before it went to court. (d) What could have been done by whom in the past (or what could be done in the
future) to avoid problems of this nature? • Include all of the above points as section headings in your report, and use separate paragraphs for
each point. • Start each case on a new page and organize your report to include the following:
(i) Title page (include paper title, course, instructor, department, school, date, etc.) (ii) Table of Contents (iii) References (including list of Internet articles and books) (iv) Appendix: Attach copies of the actual case articles (writeup) from magazine/Internet.
Maximum of 5 pages for each article. Print on both sides. • Grading System: Written report will be evaluated in the following areas: Content - - - - - - - 50 Grammar - - - - - - - 20 Organization - - - - - 30 Total Points = 100 points (equivalent to 10% of final grade)
