I. Dispatch and Arrival

The security guard told them to take it outside. I saw them go toward the parking lot, and about ten minutes later, I heard several loud pops that sounded like gunfire. When I came out, cars were speeding off, and I saw Jermaine’s silver Honda with the door open. I didn’t see Tone after that. I’ve seen Tone around before. He drives a dark blue Dodge Charger, newer model. I’m willing to testify to what I saw.

I gave the officers the video file from my doorbell. It caught the audio and a shadow of a car speeding away.

During review of supplemental agency databases, the Miami-Dade Crime Analysis Division identified that Marcus “Tone” Rivera and Andre Bennett are both listed as associates within the 2023 South Block Group intelligence file. The entry was initially created by the Violent Crime Intelligence Center and reflects multiple mutual social media connections and prior field interviews.

Network tracing of Facebook and Instagram activity revealed that Rivera, Bennett, and Carlos Torres interacted within a small, overlapping digital network between January 2023 and February 2024, including shared geotagged posts and direct message exchanges referencing the “14th Avenue area.” These relationships strengthen the inference of a shared social and spatial nexus relevant to the ongoing homicide investigation.

V. Analytical Assessment

• The temporal sequence between ShotSpotter (23:42:18) and first LPR hit (23:43:05) supports high-confidence correlation.

• Geospatial path (NW 18 → NW 79 → Opa-Locka) aligns with likely escape route from Liberty City toward Hialeah.

4. Trajectory Examination: Vehicle door panel showed entry at approx. 38° downward angle right to left; supports shooter standing adjacent to driver’s door at time of discharge.

III. Results and Interpretations • Cartridge casings (Items 001) exhibit matching breechface and firing-pin impressions to

test casings from Glock 19 #BKX732. • Projectile fragment (Item 002) exhibits class characteristics consistent with Glock 9

mm rifling; individual marks sufficient for association to Glock #BKX732. • The firearm has been previously entered into NIBIN and linked to Case 23-1774-F

(Weapon Possession by Felon – Marcus Rivera).

Conclusion: All submitted evidence is positively identified as having been fired from the Glock Model 19 #BKX732 seized in Rivera’s prior case.

IV. Forensic Intelligence Summary • The recovered casings and projectile represent a continuation of firearm use previously

documented in 2023 case. • NIBIN linkage provides investigative corroboration connecting Rivera to current and past

firearm incidents. • This information should be disseminated to ATF Miami Field Division for cross-case

I. Affiant Identification I, Detective Ana Delgado, badge #4128, am a sworn law-enforcement officer with the Miami- Dade Police Department (MDPD), currently assigned to the Homicide Bureau. I have been employed by MDPD for 12 years and have served as lead investigator in more than 40 homicide and officer-involved-shooting investigations. I have specialized training in crime-scene management, electronic surveillance, cell-site analysis, and intelligence-led policing.

II. Purpose of Application This affidavit is submitted in support of a warrant authorizing the search and seizure of cellular and digital location data, social-media communications, and telecommunications records associated with:

• Target Device: Apple iPhone 13, IMEI 358 772 641 992 118 • Target Number: (786) 555-4732 (Sprint Wireless) • Account Holder: Marcus Antonio Rivera, DOB 04/22/1995

The requested data will assist in determining the location, movements, and communications of Rivera during the homicide of Jermaine Holloway on April 13, 2025, at approximately 23:42 hours near NW 18 Avenue and NW 62 Street, Miami, Florida.

III. Facts Establishing Probable Cause

1. Incident Overview. On April 13, 2025, at 23:42 hours, MDPD Communications received multiple 911 calls and a ShotSpotter alert of six gunshots near NW 18 Avenue / NW 62 Street (CAD #25-0413-8821). Responding officers located Jermaine Holloway deceased beside a silver Honda Civic, apparent gunshot wounds to the torso.

2. Eyewitness Information. Witnesses Tanya Lopez and Carlos Torres identified the suspect as “Tone,” known to them as Marcus Rivera, seen arguing with Holloway outside King’s Hookah Lounge minutes before shots were fired. Witness Andre Bennett provided RING footage recording a male voice saying “Tone, stop playin’” immediately before six gunshots.

3. Technological Evidence. ( a ) ShotSpotter timestamp (23:42:18 hrs) corresponds with LPR camera data showing a dark blue Dodge Charger, plate QXZ-92J, departing northbound at 23:43:05 hrs. ( b ) The vehicle is registered to Luis Navarro, Rivera’s cousin and known associate. ( c ) Ballistics analysis later confirmed the use of Rivera’s previously seized Glock 19 (see Forensic Report 25-H331-BALL).

4. Historical Pattern and Digital Use. Rivera has maintained a verified Instagram account (@Tone305) and Facebook profile under the alias “Tone Rivera.” Witness Lopez advised that Rivera was “posting crazy stuff after the fight.” A review of open-source social-media content indicates an Instagram story posted at 00:10 hrs showing a dark vehicle captioned “Don’t try me.” The post was removed within 30 minutes.

5. Nexus. Based on my training and experience, individuals committing violent offenses frequently carry and use cell phones before, during, and after the crime for coordination, flight, and communication. Cell-site location information (CSLI), geofence data, and social-media metadata are likely to identify Rivera’s presence near the crime scene and his subsequent movements documented through LPR captures.

IV. Items to Be Seized 1. Historical and real-time CSLI and GPS ping data from April 13 at 18:00 hrs through

April 14 at 06:00 hrs. 2. Text, voice, and data records from Sprint Wireless pertaining to the target number. 3. Social-media communications, images, and metadata from Instagram and Facebook

associated with Marcus Rivera (“Tone305”). 4. iCloud backup records of the target device (Apple subpoena return). 5. Subscriber information and associated IP logs.

Based on the foregoing facts, there is probable cause to believe that Marcus Rivera used the above-described devices and accounts to plan, commit, and conceal the homicide of Jermaine Holloway. Electronic data associated with these accounts will constitute evidence of the offense and are lawfully subject to search and seizure under § 933.02(1), Fla. Stat. and the Fourth Amendment.
