Case Analysis _Wilson v. Southwest Airlines Company
CASE ANALYSIS INSTRUCTIONS
EACH PERSON WILL SELECT A CASE FROM THE CHAPTER AND READ AND ANALYZE THE CASE SELECTED BASED UPON THE TEMPLATE BELOW.
The assignment will consist of an individual Word Document, 2-3 pages in length double spaced, 12-point font, 1-inch margins not including Group title page and Group reference page. (Short papers will lose significant points!!). All cases will automatically be submitted to Turnitin. Your paper should follow the case format (below) and include a summary of the relevant facts, the law, judicial opinion, etc. Your grade comes from the content contained in the actual submission. All individual papers will be collated into one paper with a Conclusion
1. Must have quality in terms of substance, form, grammar, and context. Be entertaining! Use excellent visual material
2. Wrap up with a Conclusion. This should summarize the key aspects of the various decisions and your recommendations on the court's ruling.
3. Include citations and a reference page with your sources. Use APA style citations and references
4. Submit your assignment
Research the case using the case name or citation in the Library under databases: Database-HeinOnline (see attached), the web-based JUSTICA.com or FindLaw.com. Research the parties and circumstances of the case itself. Read the questions following the case to assist in focusing on your discussion and writing. Read and understand the case or question assigned. Show your Analysis and Reasoning and make it clear you understand the material. Be sure to incorporate the concepts of the chapter we are studying to show your reasoning.
Legal research should include something about the parties or other interesting related area. Show something you have discovered about the case, parties, or other important elements from your own research. Be sure this is obvious and adds value beyond the legal reasoning of the case.
NOTE: EACH GROUP MEMBER WILL SUBMIT THE GROUP PAPER THROUGH HIS/HER OWN PORTAL. WHILE YOU WILL ALL BE GRADED EQUALLY FOR THE GROUP CONCLUSION; YOU MAY RECEIVE DIFFERENT GRADES FOR THE INDIVIDUAL CASE ANALYSIS.
CASE ANALYSIS FORMAT – Prepared by each Member –
I. Introduction-: The Introduction will be completed by entering the required information after each heading:
Citation: Enter the name and citation of the case.
Parties [Identify the plaintiff and the defendant]
Identify the Court in which the case was first filed.
Identify the original verdict and which party appealed the result.
Identify the Court to which the appeal was made.
II. Plaintiff and Defendant-:
Facts For Plaintiff: [Summarize the facts which caused the case to be filed. What did the Defendant do to cause the harm? What, if anything, did the Defendant wrong? Did Plaintiff and Defendant do anything to resolve this matter before filing the complaint? What was the cause of action which was the basis of the Complaint? What are the elements which constitute that cause of action?]
Facts For Defendant: [How did the Defendant respond to the Complaint? Did Defendant Answer, Demurrer, Motion for Summary Judgement, Motion for Judgement on the Pleadings, Motion for Dismissal? What were the circumstances and facts that Defendant used as the argument/basis for the response? Did Defendant try and resolve this dispute before filing the response?]
Procedure [What was the outcome in the lower court(s)? Who won or lost? What was the reason the lower case gave for its decision?]
Decision: [Do you think this decision was correct? Why or why not?]
III. Decision of the Equal Employment Opportunity Commission, Appellate or Supreme Court:
