Complaint business letter
This is a hypothetical assignment in which you are pretending to be Napoleon Dynamite. After moving into an apartment, which you and your best friend Pedro are renting pursuant to a lease agreement, you realize that there are some problems with the apartment. As such, you call your landlord, Mr. Yunioshi, to complain about the problems, and he assures you that he is sending someone up to fix them. However, a month goes by and no one has shown up to fix the issues, so you decide to write Mr. Yunioshi a legal complaint letter. The assignment is to draft Napoleon’s letter to Mr. Y unioshi.
*I note that all of the facts for the hypothetical scenario which forms the basis of this assignment are set forth in the attached conversation dialogues between (1) Napoleon and Uncle Rico and (2) Napoleon and Mr. Yunioshi.
In your letter, I would like you to: (1) Begin with a brief, general and professional introductory paragraph (e.g., Hello, this is Napoleon Dynamite, and I write to complain about some problems with my apartment...)
(2) Reference your prior telephone conversation with Mr. Yunioshi (which is transcribed in the aforementioned attachment).
(3) Specify exactly what you want repaired.
(4) Reference relevant portions of the applicable lease agreement (linked in your assignment e-mail and on Moodle).
(5) Reference the governing warranty of habitability law (linked in your assignment e- mail and on Moodle).
(6) Tell Mr. Yunioshi how he can contact you.
You should use a professional and courteous tone in writing the letter, and avoid being too contentious and adversarial.
*You will realize that the applicable lease agreement is extremely landlord-friendly. As such, you will probably have some difficulty locating relevant portions of the lease which actually support your argument. I just want to stress that the assignment was designed this way, as the vast majority of leases are very favorable to landlords. Given this, I am
asking you to get a little creative in fashioning a pro-tenant argument via the provided lease provisions. Please do not hesitate to contact me with any questions on this issue.
