BUS 10 Senator’s Decision: Section 230 In this assignment you have the role of a U.S. Senator. In the Senate, you will soon be debating and voting on potential changes to the law known as “Section 230.” Your staff members are collecting background information for you to review. You have determined that you need to answer the following questions in order to have an informed opinion of the law before you weigh in during the debate.

1) Give a brief summary of Section 230 of the Communications Decency Act of 1996. (two to three paragraphs are sufficient. (2 points)

2) What is the relationship between the First Amendment of the U.S. Constitution and Section 230? Explain. (2 points)

3) The immunity offered by Section 230 requires a three-prong test. List the three elements of this test. (2 points)

4) What are the limits to the protections provided by Section 230? (2 points) 5) List and describe one case involving Section 230 that has influenced the interpretation

of Section 230 in subsequent cases or has led to new legislation around Section 230. (2 points)

6) Do other countries have legislation similar to the Unites States Communications decency Act, Section 230? (if so, give the country and list and describe the example) (3 points)

7) What potential effect would change(s) to Section 230 have on the business operations of companies of such as Facebook, Google, and others? (3 points)

8) Will you vote to keep Section 230 as is (no changes) or will you seek to amend Section 230? Please proved a detailed rationale for your response. (4 points for the explanation, not the actual decision)

Limit the paper to between 3 to 5 pages (with a 5-page maximum); you may use 11-point or 12-point characters with double spacing. At the end of your paper provide a list of refences used. Label your response to each question by the numbers used above. Be sure to include your full name and the course and section number at the start of your paper. This Wikipedia article is currently under development and should not be taken as authoritative but as a useful starting point for your work. You may also reference the many Section 230 articles available online. Grading Rubric Questions 1 through 4: (2 points possible) 1 = partial answer (1 point for a partial answer/summary) 2 = complete answer (2 points for a full and complete answer/summary) Question 5: (2 points possible) 1 = case subject with brief description of the nature of the case 2 = case subject, description, conclusion and reasoning Question 6: (3 points possible) 1 = list the country and provides title of the law 2 = list the country and minimal description of the law 3 = list the country with clear and thorough description of the law Question 7: (3 points possible) 1 = minimal change to business operations described 2 = list potential changes to business operations, moderate description of the effect of the changes clearly articulated but not all that were available 3= clearly articulated reasons of the effect on business if the law is changed or kept the same. Question 8: (4 points possible) 1 = minimal rationale presented for final decision 2 = rational presented but with strong defense lacking 3 = some points clearly articulated but not all that were available 4 = clearly defined rationale for decision with back up references You are expected to have checked your spelling and grammar. As part of the scoring process used above, your spelling and grammar will be considered as factors in the points awarded.

Grade Calculation with Example Grading process: Each question is scored with the above criteria to arrive at your base score. Note: One or two points may be subtracted from this base score as a consequence of misspelled words or errors in grammar. One or two points may be subtracted for not providing your references. Total points possible: 2,2,2,2,2,3,3,4 = 20 (sum of points for all questions) Spelling and grammar errors may result in 1 or 2 point reduction. Not listing your refences may result in a 1 or 2 point reduction Example paper graded as follows: 1,2,2,2,2,2,3,3 = 17 base score (sum of points for each question answered). However, due to spelling error(s) one additional point is to be subtracted. This results in 17 -1 or 16 points earned. Finally, the total number of points earned is multiplied by 10 to give the assignment’s total score for recording in the Canvas gradebook. In this example points awarded are 160. Be sure to complete and submit this assignment by the due date posted on the course Canvas website. Per the course syllabus requirements, any student that does not complete this assignment will have their course grade significantly reduced regardless of total points earned in the class.
