Recovery Strategies
Legal issues are the cases that require the decision of the court to solve. In many institutions and organizations, the employees are protected against legal issues that may affect their daily work in the corporation. The legal laws protect all the workers in the state from being exploited and oppressed by their employers. The rules that govern the functioning of the workers in the workplaces are meant to ensure that all workers are treated equally as it is dictated by the constitution. Legal issues that the workers face are discrimination on the basis of gender, age, race and pregnancy. The workers can take their employers to court in case they feel that the employer violate their legal rights and are being oppressed. This paper presents gender discrimination in Burch versus Tesco stores limited.
The court ruled in favor of the store though it had found that the stores had discriminated against the employee on the basis of gender. Gender discrimination is the undermining of one gender in the allocation of tasks. One gender is seen to be incapable of accomplishing a certain task in time and professionally such that the other gender gets the opportunities in organizations. The court justified the decision of Tesco stores limited as it found out that the employer’s needs were the main cause of the discrimination. The employer needed the employee to work flexibly and be available at more frequent times than the usual one. The employer in this case proved that they were considerate of the opportunities that it presented to the employee (Lane and Ingleby, 2017). The store did not wish to damage or produce low quality and services due to wrong allocation of tasks.
The public who are majorly the clients to the Tesco stores were aware of the issue and had started discussing the firm activities. The firm needed to strategize on the various things that would make the business create a good relationship with both the employees and the employers. The company first of all documented the relationship that it had with the employee as a strategy. This indicated the various things the company had indicated in the making of their decision in favor of the employee. This action in turn put more employees into working more and the company saw the strategy effective as it reduced laxity from the employees. The laxity was due to the company’s liability that had been exposed by the case. This action was meant to reduce and avoid the chances that could lead to resistance by the employees. This move was accompanied by increase in the salary for all the employees in the store to act as motivation and to reduce tension among the employees (McClelland, Williamson and Khanfar, 2018). The obligations of the employees were put in the document that would ensure that the deal went well in case of a dispute occurred.
The company conducted training among the employees that were in the organization by the use of the Human resource personnel. The human resource personnel conducted training to help the employees learn the various ways in which discrimination could be avoided. The human resource personnel informed the employees on their rights provided in the legal laws. The need for the employees to be aware of the various ways of discrimination will be effective in enhancing cooperation among the employees. The human resource practitioners provided the strategies that could be used to solve issues that affected the administration and the workers. Communication skills were found to be the key thing that all the workers need to have. These skills would enable the employers to communicate their concerns to the employees and the employees to the employers. This would reduce instances of violation of the legal rights of the employees and facilitate good enactment of policies of the company (Sims, 2014). The company decided to have regular meetings that would watch over the co-worker relations and assure about discernment at any level in the store.
