Impact of Wrong Condemnation Due to Lack of Proper Representation

Introduction

The United States correction facilities have expanded in terms of population by alarming rate since the 1980s with the consistent number of convictions experienced in the last decade. The high number of legal detentions has caused an upward trend in the jail population. However, the balance in the administration of justice is interfered with by the nature of defense one hires. Generally, public protection is considered to be the most engaged and hardworking in the criminal justice community. The situation is regarded by the reliance of poor individuals that cannot hire quality private defense. The poor people end up hiring public protection that is too strained to defend them effectively. Figures show that the large numbers of people that are charged with a felony are indigent thus have to depend on public defense. In recent times the public defenders have been turning plea to represent new clients due to workload they cannot handle. The high cost of depending on federal defenses that impact chances of fair trial significantly, thus ending up either in plea bargaining or incarceration (Sawyer & Wagner, 2019). Individuals relying on the public defense end up being detained despite their innocence that impacts their life significantly. Individuals that lack proper representation are subjected to wrong condemnation end up abused in areas of trust that threaten the stability of society.

Individual Stigma

Individuals that lack proper representation ends up wrongly condemned that end up in lethal end spectrum. Also, wrong condemnation causes victims severe psychological and physical trauma as the individual feels nothing common than blame. The feeling of being wrongly condemned attracts aggressive and illegal emotions such as scorn, contempt, anger, hate, resentment, and disgust towards the person behind their miseries. On the other hand, society depicts a harsh attitude towards such individuals with an emphasis on severe punishments for the wrongs they did not commit. The culmination of events exposes such as individuals to an inevitable series of emotions and feelings. The contemporary society is experiencing increasing vehement and honest public outcry calling for more vengeance. The victims end up being impacted by the impression downplaying the essence of correctional services. It makes one feel the unwanted or unnecessary burden in society (van, 2015). One is inevitable to all sorts of misconceptions, even on the criminal justice system that is expected to fuel equality in society. Such individuals end up in critical implications even after serving jail term as the society will always hold the contrary. It becomes hard for one to switch back to a healthy life again. The victims start to feel undervalued by society, thus can even go extreme to taking one life.

Society Stigma and Stability

Wrong condemnation due to failure to afford proper representation causes stigma not only on the individual but the poor people in the society. An analysis of median pre-incarceration income for people serving jail terms indicates that the system of money is a non-functional justice administration method. The capability for paying bonds is not possible for many people, and almost everyone is expected to pay. Study shows that individuals from African American and Hispanic that are under detention live below the poverty line. In using money bail as leverage in justice administration, the local jails are detaining too many people that have chances to showing on the case day or avoid engaging in another crime. It seems okay for individuals that are self-aware that they are offenders. However, it turns to be a different case for the person wrongly condemned thus has to be detained for lack of proper representation. The individuals will be vulnerable to two injustices of the system that is being convicted erroneously coupled with mistreatment for lack of money bail.

Individuals in wrong condemnation result in stigma in society hence a threat to future stability the contemporary society. The justice system will add more shame on the individuals due to the tendency of expecting him or her to afford money bail after failure to hire quality defense. The stigma is not limited to the victim only, but the rest society members that fall in a similar social category. The criminal justice system is viewed with contempt as a tool to keep the poor in control while the rich can enjoy appropriate justice due to the size of their pockets. Prolonged injustices in society are the recipe for bureaucratic fighting in community, and repercussion is intriguing. The vulnerable in society are exposed to trauma, downplaying the essence of equality in justice administration. It attracts questions on the integrity of the justice system to accord equal privileges. The implications are increased resistance of law from the lower class that feels discriminated. In the US jails, most of the people under detention are the poor that leads to the observation that the poor are sidelined in justice administration (Glaze & Maruschack, 2010). The increased convictions rate of the poor is an indication of the rebellion within the society. Most of the vulnerable individuals in the community make severe decisions such as taking life, drugs demonstrating the level of stigma on disadvantaged groups in society.
