1. Description of a business situation that presents a legal and ethical issues.

a. A manufacturer who failed to properly test a product that could have caused harm to its consumers and the environment.

b. Negligent torts are not deliberate; however, it is when an individual or entity fails to act as a reasonable person to someone to which they owe a duty to.

1. It is expected that the companies maintain a specific standard when manufacturing and or producing products that are being sold to the public.

2. A description of at least two ethical theories under which the situation will be analyzed.

a. Ethical absolutism an ethical philosophy tied in to the central idea that there are certain universal standards by which to measure morality and justice.

b. Ethical philosophy A set of beliefs about right and wrong that guides decision making both in individuals and in societies at large.

3. An explanation of the specific areas of law under which the situation will be analyzed

a. Strict Liability in Tort – “strict liability is a recently developed theory in law that holds manufacturers, wholesalers, and retailers liable for defects in the design or manufacturing of products that render such products unreasonably dangerous to the intended users” (Seaquest, 2012).
