I) Pick one of the three case fact patterns I have posted entitled Extra Credit Case
II) Figure out what rule of law applies to this fact pattern
III) Write a 2-4-page paper (double spaced) arguing each side of the case i.e. the Plaintiff and Defendant (Respondent). Use Format outlined below
IV) Your argument must be a legal argument weaving the facts into the rule of law.
V) Format:
a. Facts - Background information
b. Issue – Define the legal issue in the case fact
c. Rule – Define the rule of law that applies to this case facts
d. Argument – Use the facts of the case supported by law to tell the judge why he/she should rule in favor of the plaintiff and then argue the other side.
e. Don’t forget to have a paragraph for argument on the Plaintiff’s side and a second paragrapharguing for the Defendant (Respondent) side. Separate the paragraphs
f. Conclusion – give me a very brief (1-2 sentences) statement of who you think should win and why.
VI) Don’t forget to argue (analysis the case) for
both the Plaintiff and Defendant (Respondent)
VII) Grading is as follows:
a. Facts – 5 points
b. Issue – 10 points
c. Rule – 10 points
d. Argument for Plaintiff – 20 points
e. Argument for Defendant – 20 points
f. Conclusion – 10 points
