Penalty
· Considering all the matters raised above, I implore Your Honour to find that it is expedient, without recording a conviction for the offence, to discharge me under a conditional release order. This will allow me to continue to work and to care for my family and elderly and needy parents and at the same time I understand the onerous consequences that will flow from me breaching the terms of the conditional release order imposed.
· If Your Honour, is not prepared to exercise his/her discretion in the manner referred to immediately above, I implore Your Honour to disqualify me from driving for the minimum period of 3 months (backdated to the date my driver’s licence was suspended by the Police, being 18 March 2020) and to impose the minimum 12 months interlock order.
· Further, I do have the capacity to pay a modest fine.
Monetary Penalty
· If Your Honour is minded imposing a monetary penalty, my household monthly expenses are:
1. Mortgage repayments - $3,700.00
2. Vehicle loan repayments - $1,500.00
3. Vehicle expenses including petrol, maintenance, insurance, and registration - $1,000.00
4. Utilities, rates, internet and telephone - $800.00
5. School expenses - $2,500.00
6. Food and household supplies - $1,000.00.
Total: $10,500.00 per month
