Hazardous and Solid Waste Amendments of 1984
Purpose of the Amendments
The Amendments of 1984 were an extension of the Resource Conservation Act of 1976. The Amendments provided more in- depth programs to control hazardous and solid wastes.

Also contained new additions that the 1976 act did not cover, such as the regulation of underground storage tanks containing hazardous materials.
What Is the RCRA of 1976?
The Resource Conservation and Recovery Act of 1976 represented a first attempt to create a federal system for enforcing a national policy in dealing with the handling, treatment, storage, and disposal of toxic and hazardous materials.

Standards were then put into place for testing, identification, classification, licensing, transportation, storage, and disposal of hazardous wastes. The most important set of amendments that came out of RCRA was the Hazardous and Solid Waste Amendments of 1984. (HSWA)
What Did the HSWA Add?
The Amendments added set deadlines for permit insurance and closure of facilities not meeting standards. Prohibited land disposal of many types of hazardous wastes. Required the use of specific technologies at land disposal facilities.

Established a new program regulating underground storage tanks. Established a corrective action program. Created a national policy for reducing or eliminating the generation of hazardous wastes. Created a new policy for the management of hazardous wastes.
What Was the New Policy?
Stated that land disposal was only to be used as a last resort unless one of the following conditions were met.
1. The EPA determined that “to a reasonable degree of certainty, there will be no migration of hazardous wastes from the disposal unit for as long as the wastes remain hazardous.

2. The hazardous waste received pretreatment according to standards set by the EPA.
What Else Did HSWA Accomplish?
Brought small quantity waste generators under regulation. Stated that states with a solid waste program were required to prepare a solid waste management plan. States were required to provide permits for the facilities that handled hazardous wastes.
Who Is Affected by the Act?
The Act affects owners, operators, generators, and transporters of hazardous materials. Also affects the environment, people, and animals.
Sample Standards
Subpart H of 29 CFR 1910 deals with hazardous materials. Subpart Z of 29 CFR 1910 deals with toxic and hazardous substances.
