Midterm Exam: Covers first part of the semester materials (Cassese Chpts 1-15 (but not 4, 10, 12))

Structure 3 short answer (8.33 pts each) and 3 essays (25 pts each)---(going to add one more essay)

Instructions: HANDWRITE your short answers and TYPE your essays.

1. In Chpt 5 Cassese describes the rights afforded to States in regards to their territory, waters, and air. Draw a diagram which includes these dimensions and the rights and obligations of States within those spaces.

2. According to international law what groups of people are given the right of self-determination? Who are insurgents and what types of right/obligations do they have? What types of groups may be neglected in this definition and how do insurgents differ from national liberation movements?

3. What types of immunities do Diplomats and Consulate Agents have? Make sure to discuss the difference between function and personal immunity in your answer. Why are these immunities offered?

4. How are treaties created and how are treaties invalidated? Make sure to include a discussion on reservations.

Essays need to be three to four pages in length in total (so around one to 1.5 pages each), make sure to cite your source if you are taking direct work from the slides/textbook.

1. Name and describe the general principles of international law (please include what the principle is, who it entails, and other important information concerning the principle). Which of these principles are at odds (describe), how did this happen and what does this mean for international law?

2. What are jus cogens? What specific areas of law are upheld by jus cogens? When and under what circumstances were they created? What is their purpose? Are their circumstances under which States can violate jus cogens, if so what are they, explain? If a jus cogens is violated, what should be the response by the victimized State and other States in the international community?

3. What happens when an International Law is broken? Discuss who committed the crime, the type of crime, the reaction to the wrongful act and the ways in which the Law is attempted to be settled, adjudicated, and enforced.

4. Compare and contrast ordinary breaches vs aggravated breaches of international law.
