Katz case is a landmark case that tested the concept of privacy under the Fourth Amendment.
After carefully reviewing the material in the learning activities, complete the following:
- Write a case brief of U.S. v. Katz, including facts, procedural history, issue, rule, analysis, and conclusion. Label each component of the brief.
- Answer the following questions:
- What is Justice Harlan’s formulation of the privacy test?
- Why did the majority of the Court reject the trespass doctrine?
