Basis of Punishment
Some believe that a punishment should be based on a crime committed, that is, everyone who commits the crime should receive the same sentence. This prevents disparity in sentencing and ensures equal treatment, but it removes the judge's discretion. Others believe a punishment should be based on the offender: each case should be considered separately, with the judge having the power to consider the offender's particular circumstances.
