Intentional Torts and Negligence

Read the articles “Clark County deputy sues Burger King over spit on his food” and “Can Cop Get Emotional Distress Damages for Spit on Burger?”  If the police officer sued Gary Herb (the employee who spit on the burger) for the following intentional torts, would the officer prevail?  Why or why not?  Define and analyze each tort separately.

Read the article “Woman Stabbed at Anger Management Training” and determine whether the defendant is liable for negligence in this case.  Identify the plaintiff and defendant, then consider each element of negligence to determine your answer: (1) Duty, (2) Breach, (3) Causation, (4) Injury.
