Workers' compensation is a creature of statute.  And, statutes vary by jurisdiction.  Generally, workers' compensation is an exclusive remedy for employees injured on the job.  The employee submits a workers' compensation claim, and the matter proceeds in court without a jury.  Sometimes there is an arbitration hearing.  Many times, these cases settle.  When an employer has workers' compensation insurance, as they are required to have, the employee must submit a claim to the insurer, and cannot proceed in a lawsuit against his employer.  If the employer does not have workers compensation insurance, then the employee is able to sue his employer directly.  What is one issue you learned in researching your state's workers' compensation statute about benefits, or claims, or coverage
