HARRY:
Harry owns a car dealership. He decides to appoint Anne B to manage the used car department.
He promises Anne B a ”free hand” running the used car department. Anne B decides that she
can do better by opening on Sundays. She believes this will help her make more sales. There is
no law prohibiting her from opening on Sundays but Harry is opposed to doing business on
Sundays, the day or rest. He instructs Anne B to remain closed on Sundays. Is Anne B required
remain closed Sundays?
ROGER:
Roger buys new flooring for his six bathrooms from Ace Flooring (Ace), a discount retailer of
various types of floor coverings. Ace does not have any installers on its staff, but tells Roger that
it will arrange to have the flooring installed by one of the “licensed, bonded contractors who
work as installers for us.” Ace arranges for Tommy Tile to install Roger’s flooring. Tommy runs
his own small business and does jobs for various flooring businesses and for homeowners. Ace
does not guarantee Tommy any regular work and pays Tommy a flat fee per square yard on each
installation. (The fee varies depending on the floor covering installed).
Tommy goes to Roger’s house with the flooring in hand and the materials necessary to install it.
Among the materials is a highly volatile adhesive that is one of the most effective adhesives for
securing the flooring to the subfloor. But Tommy did not read or follow the instructions on the
adhesive resulting in a fire breaking out. Roger sued Ace under respondeat superior. What
result?
FRIAR TUCK
In his first meeting with Friar Tuck, Robin Hood compels Tuck to carry him across a stream.
Hood uses his sword as the instrument f coercion. Tuck undertakes the task, but midway across
purposely drops Hood into the stream. Is there an agency between the two? If so, has Tuck
breached his duty of loyalty? Does it matter if Tuck’s conduct is grossly negligent rather than
intentional?
