Introduction
Criminal statutes include all or part of the five elements of criminal liability. Every state and local jurisdiction has criminal laws and ordinances.
Initial Post Instructions
Choose a crime from a local newspaper or website. Research the criminal law defining the crime. Then, address the following in your post:
- Identify and discuss the elements of the crime that the prosecution has to prove beyond a reasonable doubt: actus reus, mens rea, concurrence, attendant circumstances, and bad result.
- If one of the five elements is missing, identify the element and detail.
- Detail why the element is not present in the definition of the crime.
- Finally, describe how the prosecutor can prove beyond a reasonable doubt the elements listed for the crime.
