This homework is for my administration of justice class.....topic is the Insanity plea.....

MUST ANSWER ALL OF THE FOLLOWING QUESTIONS PERTAINING TO INSANITY DEFENSE IN CALIFORNIA LAW.......

The State of California currently uses the M’Naughten Rule in insanity defense cases. Insanity is very easy to claim but very difficult to prove or disprove in any case. Should the law provide for an insanity defense? Which side should have the burden of proof? If a defendant is found to have been insane, what should happen to him/her? And, should California continue to use the M’Naughten Rule, the more conservative rule, or one of the other more liberal standards that are used in other states? Be certain to support your ideas with facts rather than just emotional responses.
