  • This afternoon your supervising attorney has called you into a meeting to go over the details of a fairly complex lawsuit. Your firm has been retained by Dr. Jean-Luc Teilhard, the CEO of Allied-Global Ocean Industries, Incorporated. Allied-Global Ocean, which is headquartered in San Diego, is a deep-water oil drilling firm that has a contract with Franco-Petroleum, Inc., the primary party in a contract with the Pentagon for detecting and extracting oil from deposits located off the California coastline. Under the terms of the contract, Allied-Global Ocean supplied Franco-Petroleum, Inc. with a deep-water oil drilling rig, code-named the “Endless Ocean.” The operators of the rig were in the process of capping a record-breaking oil well when an explosion destroyed the rig and caused a major oil spill in the Pacific off the San Diego coast. Franco-Petroleum claims that the explosion was caused by a design defect in the Endless Ocean rig. Ian and Lydia Urbina, the owners of Mid-Ocean Industries, an engineering firm contracted to provide the unmanned underwater vehicle used to view the deep-water well, have filed the current lawsuit. Both Ian and Lydia were injured in the explosion and their underwater vehicle was destroyed. The Urbinas have sued both Franco-Petroleum and Allied-Global. Your firm represents Dr. Teilhard and Allied-Global Ocean Industries. The complaint and the answer have been filed. The next step is discovery. This morning you and your supervising attorney will discuss the best discovery devices to use in the case. You will “discover” that the discovery process takes a lot of planning.

Paralegals must learn to identify discovery issues to assist the attorney in the discovery process, as well as prepare various discovery devices.

First, read the Allied-Global Ocean case in Chapter 8, on page 226 of your textbook. Then, answer exercise #5 in the Chapter Exercises section on page 259, questions a through e.
