In this module we continue our study of contracts by examining how and when a contract is performed, what happens when a contract is assigned to someone else, what constitutes a breach of a contract and the consequences of such a breach. In particular, we will learn the concepts of mistake, misrepresentation, undue influence and duress. We continue with a study of remedies available to the non-defaulting party.

You should consider how to react to a breach and what steps can be taken by a non-defaulting party. As well you should reflect on what a defaulting party can do to reduce the damage caused by the breach.

At the end of the chapter there is a review and summary, some key terms and review questions that might provide some ideas for your posts in the Forum.
