If Mr. Mayo case went to trail and was found guilty, as prosecutor I would recommend a determinate sentencing of five years. The determinate sentencing would be recommended for Mr. Mayo so that he knows his release date going into prison and can start mentally preparing to know how long he will have to endure prison life, for the violent crime he committed. The five years would be appropriate for Mr. Mayo crime, with the evidence we have reviewed over this case Mr. Mayo does not appear to be a potential repeat offender and murder someone else after his debt to society has been paid. In addition, if physical evidence and Mr. Mayo sincere statement about been afraid for his life is legit, then supports him been a lower risk factor when he returns to his community (Criminal Sentencing. n.d.). Finally, five years is reasonable time for an individual to think about what they have done. Then it allows them to make the necessary changes within themselves to become a better and better decision making. The five years won’t take as much of Mr. Mayo life for committing a crime in self-defense and can adapt to society upon release, increasing his chances of been a productive citizen.

As a defense attorney for Mr. Mayo I would recommend indeterminate sentencing. After, reviewing and confirming Mr. Mayo criminal and environmental history I would consider a time range sentencing. A time range sentencing allows the possibility for Mr. Mayo to get out on early release for good behavior. I believe anger management counseling would be a good first step in the right direction. As we learned this week offenders can be released early from prison meeting certain requirements. Mr. Mayo would be a good candidate for this if he could work on himself while incarcerated and show the state he has reformed and when faced with confrontational situation he can handle them better (McCurley, J. 2018).
