Read and apply any state’s “Stand Your Ground” statute to the following hypothetical facts. Analyze whether Dennis Edley would be criminally liable for murder. Hypothetical Facts:

Dennis Edley, a healthy 40-year-old man, shot and killed, with a handgun he lawfully possessed, a 30-year-old man, Vic Tim, who was pushing a shopping cart full of empty bottles and cans on a public street. Bulked up after years of weight training while in prison, Tim was muscular and imposing. He approached Edley on a crowded street, both hands on the cart, pushed Edley with the cart against a building, and said to him, “Kiss me or I will kill you. Edley shook his head no and Tim responded by growling and pushing the cart harder against his body. Edley took his handgun from a holster, exhibited it, and said “Let me go or I’ll shoot you. Don’t make me do it!" Tim pushed the cart harder and Edley shot and killed him.

Apply the murder and manslaughter statutes in your state or a state of your choice to scenarios A and B. Citing the statutes you used, relevant case law, and other scholarly research:

1. analyze and explain whether Brandi should be charged with murder or manslaughter; and

Scenario A:  Brandi is in her home and sees her ex-boyfriend out the window approaching her front door. He is holding a firearm and begins yelling at her to come outside. He fires his gun at her car and shoots the windshield, causing it to shatter. Brandi opens her front door and shoots her ex-boyfriend, killing him.

Scenario B: Pete’s neighbor Jake frequently sits on his front porch drinking in the afternoon and often, after becoming intoxicated, shouts insults at Pete about his appearance when he sees him in his front yard. One morning after being insulted by Jake the night before, Pete decides he’s had enough. Pete enters Jake’s home and kills him.

Your textbook discusses that stalking has been criminalized in every state. The authors note that cyberstalking has also been criminalized. Using scholarly research sources, identify cyberstalking statutes currently in effect in the United States. Select one state or federal cyberstalking statute and review any case law interpreting or applying cyberstalking statutes. Create a realistic factual scenario describing a pattern of sophisticated behavior by a former intimate partner that would violate the cyberstalking statute. Discuss how and why the behavior would violate the statute. Your response should cite the statute and the case law and any other scholarly research sources in the correct APA 7th edition format.
