In Miami the police used a K9 to check for drugs at the home of a suspected drug dealer. The police went onto the front porch of the house (with the dog) and the dog alerted the handler to the presence of drugs and the police obtained a search warrant and found a marijuana growing operation inside. The suspect was charged with trafficking.

At trial the defendant argued that the officers had engaged in a Fourth Amend­ment search unsupported by probable cause.
