Provide a comprehensive analysis outlining how HR can address each of the following legal issues:

  • Exempt/Non Exempt employees - although the changes proposed to these laws under the Obama administration seem to have lost steam with President Trump, the question of who gets paid overtime and who doesn't is still a hot button issue.
  • Safety - Safety will always be a legal issue facing an organization.
  • FMLA - Improperly administering, withholding, and the abuse of FMLA are issues that drive corporate counsel crazy.
  • Unfair hiring practices - This could range from EEO issues to hiring processes (i.e. illegal interview questions).
  • Terminations - Wrongful termination lawsuits happen every day and continue to be a huge issue for HR. 
  • ADA - What are "reasonable accommodations" and does that term mean the same to employer and employee?
  • Same sex benefits - This is a newer problem that has faces HR. Does the company have to pay same sex benefits in a state that has not made same sex marriage legal?
