CHRISTOPHER CARSWELL 12:31 Hello everyone
MAUREEN MILLER 12:32 Hi, Darell. We are going to be using the Chat protocol, so please only post "question" or "comment," if you have one. Otherwise, please don't post until I ask you to do so.
CHRISTOPHER CARSWELL 12:32 alright, sorry about that
MAUREEN MILLER 12:32 Did you happen to read my Inbox message to your group, or my Part 2 Discussion message to you?
CHRISTOPHER CARSWELL 12:32 yes, I'm currently still working on it
MAUREEN MILLER 12:34 I'm trying to see if I can contact your other three group members. They don't seem to be logged in to Canvas.
MAUREEN MILLER 12:35 In the meantime, please open a second Canvas classroom, and click on Modules. Then scroll all the way down until you see a module called Group Presentation Documents.
MAUREEN MILLER 12:36 You should see a Group 2 page in that module.
MAUREEN MILLER 12:37 Click on that, and you should see your one draft under procedural posture, Darell. Hiul, you will only see the issue document, remember, because the conclusion is not a case document for Part 2 of the group assignment.
MAUREEN MILLER 12:37 When you have located the Grp2 page and opened it, and verified that I have the correct (for now) documents posted there, of yours, please post "located and confirmed."
MAUREEN MILLER 12:38 I will see if I can track down your groupmates.
CHRISTOPHER CARSWELL 12:38 question
HIULERY CYNTHIA KUSUMA 12:39 located and confirmed
MAUREEN MILLER 12:46 Go ahead, Darell.
CHRISTOPHER CARSWELL 12:46 sorry mam, Hiulery already helped me to find the files
CHRISTOPHER CARSWELL 12:46 Located and confirmed
HIULERY CYNTHIA KUSUMA 12:48 question
MAUREEN MILLER 12:50 I have sent them all emails, but they do not appear to be on Canvas. Go ahead with your question, Hiul.
HIULERY CYNTHIA KUSUMA 12:51 What if our groupmates really do not attend this conference? WIll it affect me and Darell's grade?
MAUREEN MILLER 12:56 No. I have just reached Kevin, and he is contacting the other two. The three of them should be joining us in the conference shortly.
MAUREEN MILLER 12:57 In the meantime, I will look at your documents, Hiul. They should not have your name as part of the documents' names, Hiul.
MAUREEN MILLER 12:58 Darell, please work on separating your documents into two or three, as I indicated. Have you finished doing that?
CHRISTOPHER CARSWELL 12:58 I'm still on the way
MAUREEN MILLER 12:59 Do you mean you haven't finished separating your one document into multiple documents?
CHRISTOPHER CARSWELL 13:00 yes, I'm still trying to seperate it into 3 as it seemed that I forgot to add the case into my document
CHRISTOPHER CARSWELL 13:01 I'm still having a hard time understanding having to have one case document and one live commentary document
MAUREEN MILLER 13:05 It looks like you did not look at the GrpAssign page in Canvas Assignments, for the information and samples there that would have helped you with that. Your "case document" (what is going in the module page, instead of your draft document I posted there) should be a chronology of the procedural posture. This should be a set of bullet points that starts with the indictment, and then the trial court prosecution, and then why there was an appeal.
MAUREEN MILLER 13:06 Please open another window/screen for this Canvas course, and click on Assignments in the menu under Home.
MAUREEN MILLER 13:09 While Darell is doing that, I will look at your documents, Hiul.
MAUREEN MILLER 13:14 OK, Hiul, I have looked at your documents. You did the issue revision just fine--you just need to name it with a name that doesn't include your name, and says what the document is.
HIULERY CYNTHIA KUSUMA 13:15 ohhh okayy. SHould i rename it now?
MAUREEN MILLER 13:15 The conclusion has some spelling and spacing errors in it. And in the United States, we spell the word as "judgment," rather than "judgement."
MAUREEN MILLER 13:18 So you could be working on that.
HIULERY CYNTHIA KUSUMA 13:18 okay
HIULERY CYNTHIA KUSUMA 13:18 on it
MAUREEN MILLER 13:18 Darell, have you located the GrpAssign page?
CHRISTOPHER CARSWELL 13:18 yes
13:18

For help using BigBlueButton watch these (short) tutorial videos.

This BigBlueButton session is provided free of charge by Blindside Networks Inc. to Instructure customers. Recordings are automatically deleted after 14 days. For permanent recordings and other premium features, contact your canvas representative.
MAUREEN MILLER 13:20 Is that clarifying what you need to be doing for your documents, Darell?
QIBIN LIANG 13:21 i am online
MAUREEN MILLER 13:21 Kevin, did you reach Wendy and Alex, and are they going to be joining us.
MAUREEN MILLER 13:21 *us?
QIBIN LIANG 13:21 yes they are coming right now
CHRISTOPHER CARSWELL 13:26 ok I have uploaded the case document, now I will format the live commentary
MAUREEN MILLER 13:27 I will look at the case document.
MAUREEN MILLER 13:28 Kevin, I need you to confirm what your role is, and figure out your documents.
QIBIN LIANG 13:29 where we post the doc ?
MAUREEN MILLER 13:30 In your group's Files.
QIBIN LIANG 13:31 i choose the role 2
MAUREEN MILLER 13:31 Please check the Canvas Calendar. It told you about the practice this afternoon, and that your draft documents were to be posted two hours ahead in your group's Files.
MAUREEN MILLER 13:32 Alex, did you prepare any draft documents for your role?
MAUREEN MILLER 13:33 Kevin, when can we expect to see Wendy?
CHRISTOPHER CARSWELL 13:34 Alright Mrs. Miller, I've uploaded both live commentary and brief case docs in our group file
MAUREEN MILLER 13:35 If you refresh the module page, you'll see that I put the new case doc in the module page.
ZEYANG YAO 13:39 I already post my files Professor.
MAUREEN MILLER 13:40 Yes, I saw them.
MAUREEN MILLER 13:42 Looks like Wendy is here, but we have lost Alex.
MAUREEN MILLER 13:42 Wendy, do you have any draft documents ready to post?
WENQI JIANG 13:43 Yes, I post them professor.
MAUREEN MILLER 13:44 I do not see them in your group's Files.
MAUREEN MILLER 13:44 Kevin, please contact Alex, and see if he can please rejoin us in the conference.
MAUREEN MILLER 13:44 OK, I see he is back.
MAUREEN MILLER 13:46 Everyone's case docs except Wendy's are in the module page now. Please, Kevin and Alex, locate the Group 2 module page in Modules, and find your case docs. Then post "located and confirmed."
MAUREEN MILLER 13:46 No live commentary will be in the Grp2 module page.
MAUREEN MILLER 13:49 We are starting the practice an hour and 15 minutes late. Part 2 of the group assignment is worth 55 points. We will need to work very hard to get the practice done today. And we cannot have anyone miss any of the remaining work/deadlines.
MAUREEN MILLER 13:50 I first want to confirm that everyone is still available on March 8th, from 12:30 to 3:30. Please post "confirmed" if you are, or "problem," if you are not.
QIBIN LIANG 13:50 where is the group 2 module page, it is part 2 discussion ?
QIBIN LIANG 13:51 yes
WENQI JIANG 13:51 confirmed.
MAUREEN MILLER 13:51 Kevin, you need to scroll up in the conference to see what you missed in the first hour. I had hoped you would have already done that.
HIULERY CYNTHIA KUSUMA 13:51 confirmed
ZEYANG YAO 13:51 confirmed.
CHRISTOPHER CARSWELL 13:51 problem
MAUREEN MILLER 13:52 The Group 2 module page is in Canvas Modules, in the module all the way at the bottom.
MAUREEN MILLER 13:52 What is the problem, Darell?
CHRISTOPHER CARSWELL 13:52 I have a class which was delayed moved to that time, I will only be available after 2
MAUREEN MILLER 13:53 That was because of weather or power outage?
MAUREEN MILLER 13:53 Did that just happen today, Darell?
CHRISTOPHER CARSWELL 13:53 yes, I try to email my teacher if I could happen to reschedule my quiz to another time
QIBIN LIANG 13:53 located and confirme
CHRISTOPHER CARSWELL 13:54 I'll inform you once he had replied to my email
MAUREEN MILLER 13:54 Kevin, Wendy and Alex need to scroll up to the top of the conference and read what they missed.
WENQI JIANG 13:54 located and confirmed.
ZEYANG YAO 13:55 located and confirmed.
MAUREEN MILLER 13:55 Can everyone be available from 2-4PM on the 8th, if Darell's other instructor isn't able to change the quiz date?
ZEYANG YAO 13:55 I already read them. professor.
WENQI JIANG 13:56 i read the chat I have missed, professor.
WENQI JIANG 13:57 I'm Ok with this time.
MAUREEN MILLER 13:57 Thanks. Now let's work on seeing what our backup plan will be. Sounds like Wendy could do 2-4PM, if necessary.
QIBIN LIANG 13:58 I AM ok on that time.. and i read
ZEYANG YAO 13:58 The time is good for me.
HIULERY CYNTHIA KUSUMA 13:58 I can start at 2 but i can only do until 3.30pm
MAUREEN MILLER 13:59 We can probably finish in an hour, from 2:30-3:30. Since you are doing the conclusion, Hiul, and that's Step 7, it will be tight, but if everyone is very prepared, it can probably be done.
MAUREEN MILLER 14:00 And Darell, you are able to go until 4PM?
CHRISTOPHER CARSWELL 14:00 yes
MAUREEN MILLER 14:01 Then we will hope you are able to change it, but we have a backup plan, if necessary.
QIBIN LIANG 14:01 me, alex, and wendy will until 4
MAUREEN MILLER 14:02 Now I am going to go over some deadlines. I will need you all to finalize your documents, and post them 24 hours ahead of the presentation--Thursday afternoon, 3/7.
MAUREEN MILLER 14:04 We will discuss the draft documents today in the practice. Wendy, I still do not see your draft documents for the Government's argument posted in your group's Files.
MAUREEN MILLER 14:05 Never mind.
MAUREEN MILLER 14:05 I see that you did not post them in the folder Darell created.
MAUREEN MILLER 14:05 But I just moved them there.
MAUREEN MILLER 14:10 Everyone can refresh the module page, since Wendy's draft case doc is now posted there (changed the name to reflect it was the case document).
MAUREEN MILLER 14:11 All draft documents need to be finalized. We will talk about them in the practice, and they need to be revised to be in the correct form/format, as necessary, and have the correct content, as necessary.
MAUREEN MILLER 14:12 That will need to be done by no later than 24 hours ahead. I have either practices or presentations occurring every day that week except Saturday, so I really need everyone to have the drafts done by 24 hours ahead. Then I will have time to review them. This means all case documents and all live commentary documents.
MAUREEN MILLER 14:13 Be sure to name them what they are, and to not have your name in the document's name. Look at the samples in the GrpAssign page in Assignments, to help you with any revisions you need to make.
MAUREEN MILLER 14:15 Then make sure your finalized documents are all posted in your Group's Files by 1:30PM on Thursday, 3/7. Please remove your own draft documents from Files, before you post your finalized versions, so that I won't be confused about which documents to use. Does anyone have any questions about what needs to be done by Thursday, 3/7, at 1:30PM?
MAUREEN MILLER 14:16 Please answer "no" or "question."
QIBIN LIANG 14:16 no
CHRISTOPHER CARSWELL 14:16 no
WENQI JIANG 14:16 no
ZEYANG YAO 14:16 no
MAUREEN MILLER 14:16 Hiul?
HIULERY CYNTHIA KUSUMA 14:16 no
MAUREEN MILLER 14:17 The next deadline is a half hour before the presentation. If Darell is able to get the quiz moved, that will be 12:30PM on Friday, 3/8.
MAUREEN MILLER 14:18 At that time, you will all meet in your group's Conferences for a pre-presentation conference. We'll cover any last-minute issues, etc.
CHRISTOPHER CARSWELL 14:18 I just got an email from my instructor, he said that I could hav my quiz moved to another day.
CHRISTOPHER CARSWELL 14:18 We should be good on friday from 12:30 PM
MAUREEN MILLER 14:18 Great! Thanks, Darell.
CHRISTOPHER CARSWELL 14:19 I should apologize for the inconvenience
MAUREEN MILLER 14:20 So we will all meet here in Conferences at a conference I'll call a "pre-presentation" conference, at 12:30PM on Friday, 3/8.
HIULERY CYNTHIA KUSUMA 14:22 ok
MAUREEN MILLER 14:23 After we go over any last-minute issues or reminders, I will make sure that everyone is ready for the presentation. Around 1PM, we will head over to the main Chat, where we had our weekly extra credit chats, earlier in the quarter. I will tell you when to head over there. Do you all know how to access the main Chat in Canvas for this course? Please answer "yes" or "question."
HIULERY CYNTHIA KUSUMA 14:23 yes
CHRISTOPHER CARSWELL 14:23 yes
WENQI JIANG 14:23 yes
QIBIN LIANG 14:23 yes
ZEYANG YAO 14:23 yes
MAUREEN MILLER 14:23 Please do not go to the main Chat until I ask you to do so, on the 8th. Please do not even open that screen.
MAUREEN MILLER 14:24 When you get to the main Chat, please do not post anything, not even a greeting.
MAUREEN MILLER 14:25 I will tell Alex when it is time to start the presentation, and will have a signal for when to do that.
MAUREEN MILLER 14:26 At least two of the groups will already have done presentations by then, so you will be able to review how things went for them in Chat.
MAUREEN MILLER 14:27 I hope that you will serve as justices for other groups, if your schedules permit. There will be information about that in the Week 9 Overview page, next Monday.
MAUREEN MILLER 14:28 When you all join the main Chat, after I ask you to do so, on your presentation day, you should have a minimum of four screens open: 1) the main Chat,
MAUREEN MILLER 14:29 2) the pre-presentation conference (so that we can all communicate privately with each other, as necessary, during the presentation),
MAUREEN MILLER 14:30 3) the Group 2 module page in Modules, which will have your finalized case documents in it, instead of your drafts,
MAUREEN MILLER 14:30 and 4) your live commentary, ready to post in Chat when it is your turn to do so.
MAUREEN MILLER 14:31 Wendy, are you and Alex having connection issues?
ZEYANG YAO 14:32 No professor. Just refresh the page. sorry about that.
MAUREEN MILLER 14:32 Today, we will not be joining the main Chat at all. Instead, we will pretend that this conference is the main Chat.
MAUREEN MILLER 14:33 We are going to be following the sequence in the Group Presentation Guidelines, for both this practice and the presentation.
MAUREEN MILLER 14:34 So if you need to have the Guidelines open for reference, please feel free to open them now.
MAUREEN MILLER 14:35 I will be going over ground rules for the presentation and this practice, throughout the practice. I have a few to start off with, now.
MAUREEN MILLER 14:35 The first is that Chat does not like long posts. So you should prepare your live commentary in single-sentence increments.
MAUREEN MILLER 14:36 Only post one sentence at a time, when you are doing your live commentary.
MAUREEN MILLER 14:36 So when you finalize your live commentary, divide it up into single sentences.
MAUREEN MILLER 14:36 The next ground rule is about timing.
MAUREEN MILLER 14:37 We don't want to keep asking the justices if they have finished reading whatever you are asking them to read.
MAUREEN MILLER 14:38 (or whatever you are posting in live Chat)
MAUREEN MILLER 14:38 Instead, each time you ask the justices to read something in the module page,
MAUREEN MILLER 14:38 and each time you post something in Chat, please read it to yourself, slowly and carefully.
MAUREEN MILLER 14:39 Then you may just move on to the next thing.
MAUREEN MILLER 14:41 The last ground rule, for now (I'll have more later!) is about making this practice as efficient as possible. You won't be posting much in this practice. It will be more about me reviewing your drafts and suggesting revisions.
MAUREEN MILLER 14:41 But if I do ask you to post something during the practice, please only post one sentence at a time.
MAUREEN MILLER 14:42 Then wait for me to read it, suggest any corrections, and tell you to "proceed."
MAUREEN MILLER 14:42 Then you would move on to the next post.
MAUREEN MILLER 14:44 In the actual live presentation on the 8th, though, I will not be posting much. Your scripts (live commentary) for live Chat posting will all have been reviewed by me, and revised, as necessary, and you will follow those for your live posting.
MAUREEN MILLER 14:45 Sorry--had a little "connectivity" problem, apparently!
MAUREEN MILLER 14:45 Does anyone have any questions about the above ground rules? Please answer "no" or "question."
CHRISTOPHER CARSWELL 14:46 I have a question but it's not about the ground rules that you have strablished
ZEYANG YAO 14:47 no
WENQI JIANG 14:47 no
QIBIN LIANG 14:47 no
MAUREEN MILLER 14:47 Is it about something I've covered already? If not, please hold it until we get to when it's a topic being covered.
HIULERY CYNTHIA KUSUMA 14:47 no
CHRISTOPHER CARSWELL 14:47 ok I'll hold it for later
MAUREEN MILLER 14:48 Alex, I didn't see a draft Step 1 introduction posted. It looked like that was part of your role.
ZEYANG YAO 14:50 ok, I will finish it today. sorry about that.
MAUREEN MILLER 14:50 Start working on it right now, please.
MAUREEN MILLER 14:50 The sample is in Step 1 of the Group Presentation Guidelines.
ZEYANG YAO 14:51 Ok.I will do it right now.
MAUREEN MILLER 14:52 We'll assume that this is the 8th, around 1PM, and I have determined that you're all ready for the presentation.
MAUREEN MILLER 14:53 I have seen that you are all in the main Chat, and we have at least one justice, who will be earning extra credit for serving as a justice.
MAUREEN MILLER 14:54 My signal for Alex to start the presentation will be:
MAUREEN MILLER 14:55 Group 2, you may begin. Then Alex will start copy/pasting from his Step 1 live commentary, one sentence at a time. He will read each sentence that he posts, before going on to the next sentence.
MAUREEN MILLER 14:56 Alex, do you at least have the first sentence ready?
ZEYANG YAO 14:56 Yes. Good morning , Justices.
ZEYANG YAO 14:57 It should be like this professor?
MAUREEN MILLER 14:57 It will not be "Good morning" because you will be presenting at 1PM.
MAUREEN MILLER 14:57 So it will be:
MAUREEN MILLER 14:57 Good afternoon, Justices.
ZEYANG YAO 14:57 Ok. Thank you
MAUREEN MILLER 14:58 I'm going to let you work on the rest of Step 1 after it is not your turn, and we'll rehearse it after we get to the end, but need to move on, for now.
MAUREEN MILLER 14:59 Your last sentence of the Step 1 intro will be:
MAUREEN MILLER 14:59 I, Alex (Zeyang) Yao, will be presenting the background facts in this case.
MAUREEN MILLER 15:00 After Alex does the introduction, we will all get a little more formal.
MAUREEN MILLER 15:01 Darell, Alex and Kevin will all be "Mr." and their last names, and Wendy and Hiul will need to tell us if they prefer Miss or Ms. or Mrs. and their last names.
MAUREEN MILLER 15:01 Please let us know that, now.
MAUREEN MILLER 15:01 (Wendy and Hiul, please let us know that now.)
WENQI JIANG 15:01 I prefer miss
HIULERY CYNTHIA KUSUMA 15:01 i prefer ms.
MAUREEN MILLER 15:02 Everyone, please take note of that.
MAUREEN MILLER 15:02 Thanks!
WENQI JIANG 15:02 last name Jiang
WENQI JIANG 15:02 Thank you
MAUREEN MILLER 15:02 Now we have another ground rule to cover, and it's about your case documents and live commentary documents.
MAUREEN MILLER 15:03 Your live commentary cannot ever contain content that you have just asked the justices to read in the module page.
MAUREEN MILLER 15:03 Your live commentary is meant to explain or enhance what is in the module page document.
MAUREEN MILLER 15:04 When it is your turn to present, you will first ask the justices to review the module page document, if applicable.
MAUREEN MILLER 15:04 You will read it to yourself, right along with the justices.
MAUREEN MILLER 15:05 Then you will start posting your live commentary, one sentence at a time.
MAUREEN MILLER 15:05 Since Alex is presenting the background facts, the last sentence in his Step 1 introduction will be:
MAUREEN MILLER 15:06 Justices, please review the background facts document in the Group 2 page in the Group Presentation Documents module in Modules.
MAUREEN MILLER 15:06 Then we will all review that document, right along with the justices. Let's all please do that, now.
MAUREEN MILLER 15:10 I also reviewed the live commentary, Alex.
MAUREEN MILLER 15:12 I'm going to suggest that for your case (module page) document, you make the facts more of a chronology, and just start with David Nosal's hire date, his termination with the company, his change to contractor status and non-compete agreement with the company,
MAUREEN MILLER 15:13 and the creation of the competing firms, in short sentences, all in chronological order.
MAUREEN MILLER 15:15 Then, in your live commentary, you can explain all the measures Korn/Ferry took to keep the databases confidential, what Searcher was, what employees saw on the computer when they logged in (messages about confidentiality, etc.),
MAUREEN MILLER 15:16 both when employees logged in to their work computers, and logged in to the database,
MAUREEN MILLER 15:17 and what the employees did with the information they obtained from the databases.
MAUREEN MILLER 15:17 Are you seeing how the case document is giving the basics, and how the live commentary document is enhancing that, Alex?
MAUREEN MILLER 15:19 Please respond. You can work on revisions after your turn is done. The last sentence of your live commentary should be: Mr. Carswell will now present the procedural posture in this case.
MAUREEN MILLER 15:20 In the interests of time, we will move on, but everyone, when it is your turn, please be sure to communicate with me, when I ask questions of you.
ZEYANG YAO 15:20 Yes professor and I just finished my draft and post it under he files.
MAUREEN MILLER 15:21 Darell, when Alex turns the presentation over to you, you will post:
MAUREEN MILLER 15:21 Justices, please review the procedural posture document in the Group 2 page in Modules.
MAUREEN MILLER 15:21 And we'll all review that together.
MAUREEN MILLER 15:22 Let's do that now, and I'll also review the live commentary.
HIULERY CYNTHIA KUSUMA 15:22 question
CHRISTOPHER CARSWELL 15:23 question
MAUREEN MILLER 15:24 Go ahead, Hiul.
MAUREEN MILLER 15:25 Darell, I didn't see a procedural posture document in your revised documents. When I opened them up, they were both about the CFAA. Where is your procedural posture case document?
HIULERY CYNTHIA KUSUMA 15:26 i have 4 minuites left for this conference nd i have to be elsewhere soon.
MAUREEN MILLER 15:29 Hiul, I know that you were here on time for the practice, and I covered your documents a little while we were waiting for your groupmates to join the conference. You wil need to review the chat text of this conference later, to find out about the rest of the presentation.
MAUREEN MILLER 15:30 Please look in your group's Files for that chat text document, and be sure to review it completely.
MAUREEN MILLER 15:30 You are excused.
HIULERY CYNTHIA KUSUMA 15:30 Thank you
HIULERY CYNTHIA KUSUMA 15:31 bye
MAUREEN MILLER 15:32 It looks like we lost Darell, too, but we were not done with Darell's part.
MAUREEN MILLER 15:36 Darell, you need to cover the sequence of what happened in court, from the initial indictment to the prosecution and Nosal's first motion to dismiss, what the court's ruling was on that, and then the second motion to dismiss, and the appeal to the Ninth Circuit (not the result in the 9th Circuit, thought).
MAUREEN MILLER 15:36 Each of those is a separate sentence/bullet point.
MAUREEN MILLER 15:38 Then your live commentary builds on what was in the module page (case) document.
MAUREEN MILLER 15:41 You will need to discuss the trial court's rationale for its decision about the first motion to dismiss, information about the Brekka case (a civil case), and why the trial court accepted the second motion to dismiss,
MAUREEN MILLER 15:41 When you are finished with the live commentary about the procedural posture, you will begin live commentary about the CFAA.
MAUREEN MILLER 15:42 Your first sentence for that will be something like this:
MAUREEN MILLER 15:42 Justices, I would now like to give you background information about the Consumer Fraud and Abuse Act (the CFAA).
MAUREEN MILLER 15:44 Then you give an abbreviated history of the CFAA, explain what some of the important provisions are, and quote the part of the CFAA that was being examined in this case (without referencing this case).
MAUREEN MILLER 15:45 When you are finished with your background law live commentary, you will post (so this needs to be at the end of your live commentary):
MAUREEN MILLER 15:45 Ms. Kusuma will now present the issue in this case.
MAUREEN MILLER 15:46 Then Hiul will post:
MAUREEN MILLER 15:46 Justices, please review the issue document in the Group 2 page in Modules.
MAUREEN MILLER 15:46 And everyone will review that, including Hiul.
MAUREEN MILLER 15:47 Hiul will not post anything for issue live commentary, and will not post the issue, since she has just asked the justices to read it in the module page.
MAUREEN MILLER 15:47 When Hiul has finished reading the issue document, she will post:
MAUREEN MILLER 15:48 Miss Jiang will now present argument on behalf of the United States ("the Government").
MAUREEN MILLER 15:48 Then Wendy will post:
MAUREEN MILLER 15:48 (and this needs to be in your live commentary)
MAUREEN MILLER 15:49 Justices, please review the Government's argument in the Group 2 page in Modules.
MAUREEN MILLER 15:49 And we'll all review that, now.
MAUREEN MILLER 15:52 Wendy, were you able to review my Part 1 Discussion post in your group's Discussions?
MAUREEN MILLER 15:53 It was at the end of the Part 1 Discussion forum.
MAUREEN MILLER 15:54 Are you still with us, Wendy?
MAUREEN MILLER 15:56 You used the correct format for your case document, Wendy, but I revised your group's case issue, so you should only be using the revised issue in your case document.
ZEYANG YAO 15:57 yes
MAUREEN MILLER 15:57 I'm not sure it's clear from your argument case document that the Government's position is that an employee can be prosecuted.
MAUREEN MILLER 15:57 Since this is Wendy's role, I was hoping for an answer from Wendy.
WENQI JIANG 15:58 i am here
MAUREEN MILLER 15:59 I asked you whether you had been able to review my post at the end of your group's Part 1 Discussion forum, in which I discussed what your group's case issue needed to be.
MAUREEN MILLER 15:59 I don't think you have responded to that, yet.
MAUREEN MILLER 15:59 But in that post, I revised the issue. So you need to use the revised issue, not one that you have created.
MAUREEN MILLER 16:00 Then your bullet points for your argument should be something like this:
MAUREEN MILLER 16:01 • “Exceeds authorized access” should be interpreted to include someone who does have unrestricted physical access to a computer or database but is limited in the application of the accessible information. • Korn/Ferry’s computer policy give employee’s specific rights and restriction when accessing data, one of which required them to keep data confidential; when the employees violate that policy, they are “exceed[ing] authorized access.” • The “exceeds authorized access” terms should be interpreted by this court to also apply to current employees who are allowed authorization to access a computer, but then use that access unauthorized purposes
QIBIN LIANG 16:02 ok I got it. Thank you professor.
MAUREEN MILLER 16:02 Then you need to expand upon those issues in your live commentary,
WENQI JIANG 16:03 Thank you for the reminder.
MAUREEN MILLER 16:04 Be sure to include material in your live commentary that expands upon your bullet points in the case document. The last line of your live commentary should be:
MAUREEN MILLER 16:05 Mr. Liang will now present argument on behalf of David Nosal.
MAUREEN MILLER 16:05 And Kevin will post:
MAUREEN MILLER 16:05 Justices, please review Mr. Nosal's argument in the Group 2 page in Modules.
MAUREEN MILLER 16:06 And we'll all review that now.
MAUREEN MILLER 16:09 I have a few important points to make. Like Wendy, you followed the correct form/format, except that you did not use the approved (my revised) language for the issue. Please check my post at the end of the Part 1 Discussion forum.
MAUREEN MILLER 16:09 You will only be using that issue language, not your own.
MAUREEN MILLER 16:11 And you cannot reference what the Ninth Circuit actually decided. That will be Hiul's job for the conclusion. Instead, remember that we are pretending that the Ninth Circuit has not ruled on this case, yet, and that David Nosal is trying to win the case on appeal.
MAUREEN MILLER 16:11 So you have to be careful about how you phrase your argument.
MAUREEN MILLER 16:12 This decision was not based upon the "unauthorized access" language in the CFAA, but rather on the "exceeds authorized access" language.
MAUREEN MILLER 16:13 So you are on the right track with your argument, but have to make sure you focus on the right language, and do not include the conclusion.
MAUREEN MILLER 16:14 After you use the correct issue language, you will answer the question posed in the issue, and then can use these bullet points:
MAUREEN MILLER 16:15 ● The CFAA was aimed primarily at computer hackers, not employees who violate contractual confidentiality agreements. ● The Korn/Ferry employees were, in principle, permitted to access the information in their role as Korn/Ferry employees, and thus they did not “act without authorization” or “exceed authorized access” as written in Section (a)(4) of the CFAA.
● A ruling in favor of the Government here would have broad, excessive and undesirable consequences.
MAUREEN MILLER 16:15 Then your live commentary expands upon the bullet points in your case (module page) document.
MAUREEN MILLER 16:16 Do you have any questions about how to revise your documents, Kevin?
QIBIN LIANG 16:16 no
MAUREEN MILLER 16:16 And for everyone, remember that your live commentary should be in single-sentence increments, so you are only posting one sentence at a time.
MAUREEN MILLER 16:17 The last line of your live commentary should be:
MAUREEN MILLER 16:17 This concludes Mr. Nosal's argument.
MAUREEN MILLER 16:17 That is my signal to take over the presentation.
MAUREEN MILLER 16:18 I will ask the justices if they have any questions. If they do not, I might.
MAUREEN MILLER 16:19 Then I will post the issue in Chat, and the justices will vote on it. After they all vote, I will post:
MAUREEN MILLER 16:19 And what did the Ninth Circuit Court of Appeals actually decide in this case?
MAUREEN MILLER 16:20 That will be Hiul's cue to state the conclusion, one sentence at a time. She will not re-state the issue. Just the conclusion.
MAUREEN MILLER 16:20 She will start by posting: The NInth Circuit Court of Appeals determined that...
MAUREEN MILLER 16:20 and then will tell what it decided.
MAUREEN MILLER 16:22 So did the Ninth Circuit determine that an employee who violates the employer's use policies can or can't be prosecuted under the CFAA?
MAUREEN MILLER 16:23 You should all be clear about that.
MAUREEN MILLER 16:23 Please answer.
ZEYANG YAO 16:24 I am clear about it.
MAUREEN MILLER 16:24 What is the answer to the question I just asked, Alex?
ZEYANG YAO 16:26 can be prosecuted under the CFAA
MAUREEN MILLER 16:26 Not in this case, for this issue, Alex.
MAUREEN MILLER 16:27 I will let you all re-read the case, so that you can be clear about it. And make sure you read the right case.
MAUREEN MILLER 16:28 After Hiul gives the correct answer to the issue question for this case (the one with this citation), Hiul is going to do an update.
MAUREEN MILLER 16:29 I will post something like this:
MAUREEN MILLER 16:29 Did the Government give up trying to prosecute Mr. Nosal?
MAUREEN MILLER 16:30 Hiul will then state:
MAUREEN MILLER 16:30 The Government did not give up on trying to prosecute David Nosal and his co-conspirators, for using that confidential data for the competing business.
MAUREEN MILLER 16:34 There was a second indictment and prosecution of Mr. Nosal and his co-conspirators, the appeal for which was reported at 828 F.3d 865 (9th Cir. 2016).
MAUREEN MILLER 16:36 And then Hiul will give information about how that second indictment and prosecution was based upon the "without authorization" language, when an outsider, like former employee Nosal, is involved.
MAUREEN MILLER 16:38 After Hiul is finished with the follow-up, I will thank and excuse the justices, then thank your group, and conclude the presentation. Then all of you will meet me back in your group's pre-presentation conference, so that we can go over any additional items.
MAUREEN MILLER 16:39 Do you have any questions about Part 2 of the group assignment?
ZEYANG YAO 16:39 No professor
WENQI JIANG 16:40 No
QIBIN LIANG 16:40 no
MAUREEN MILLER 16:43 The Part 3 issue-conclusion document will be due the same day as your presentation, so be sure you all work together to complete that.
MAUREEN MILLER 16:43 Did you all just forget about the practice?
MAUREEN MILLER 16:44 It looked like Wendy might have logged into Canvas at about the same time the practice was starting, but then didn't join the conference.
ZEYANG YAO 16:44 What do you mean by the practice professor?
MAUREEN MILLER 16:45 What we are just finishing now, Alex.
MAUREEN MILLER 16:45 You were supposed to be in this practice conference at 12:30.
ZEYANG YAO 16:46 Yeah, I am so sorry about it because I thought we only need to turn in the files not this practice.
WENQI JIANG 16:47 Yes, and I send them the message to remind them
QIBIN LIANG 16:48 Sorry, Professor. i will be on time on Mar 8
MAUREEN MILLER 16:49 You're clear now that you have a 24-hour deadline for finalized documents posted in your group's Files on Thursday, the 8th, at 1PM, and then you need to be in the pre-presentation conference in your group's Conferences at 12:30PM on the 8th, and you don't go to Chat until I let you know it's time to do so on the 8th?
MAUREEN MILLER 16:49 *Thursday the 7th
MAUREEN MILLER 16:50 I'm going to remind you all about how to save the chat text for everyone in your group to reference. There are two ways to do that:
ZEYANG YAO 16:50 I am clear about it Professor and will be there on time. Sorry again for the late come.
MAUREEN MILLER 16:51 The first is to hold your mouse over the chat text until the cursor becomes an arrow, then right-click on the arrow,
MAUREEN MILLER 16:51 and left-click on the Copy All Text that appears.
MAUREEN MILLER 16:51 Then Control C to paste that copy into a blank Word document,
MAUREEN MILLER 16:52 name it something like PracticeChatText,
MAUREEN MILLER 16:52 and save it as a Word doc.
MAUREEN MILLER 16:52 The second way is to click on the Options tab above the Chat Text,
MAUREEN MILLER 16:53 then click on the middle (Copy) icon for Public Chat Options,
MAUREEN MILLER 16:54 and paste that into a blank Word document, following the same naming/saving instructions as above.
MAUREEN MILLER 16:55 Do I have a volunteer who can post that document in your group's Files for everyone to use?
ZEYANG YAO 16:56 I can do it professor.
MAUREEN MILLER 16:57 Thanks, Alex. Thanks, everyone, for being here. This concludes the practice.
MAUREEN MILLER 16:58 (This conference will end, as soon as you all exit, and the module page will disappear until the day of your presentation.)
WENQI JIANG 16:59 Thank you Professor.
QIBIN LIANG 16:59 Thank you prodessor.
ZEYANG YAO 16:59 Thank you Professor and sorry again.
