Hello Professor/Classmates

Analyze the primary manner in which the purchase of fake handbags or other counterfeit merchandise may impact all areas in our lives.

One of the key reasons counterfeit merchandise impacts us is through rising cost of the real items, even medicine. Additionally counterfeit merchandise also has an effect on the  job market, though the lost of jobs.  Most American don’t really see the damage the counterfeit merchandise has on our economy. It has been estimated that the counterfeit purse market alone, cost industries like Coach, Fendi, MCM approximately one hundred to two million dollars in lost revenue. This is just the purse industry, it is thought to be in the trillion-dollar range when you combine all the other industries, E.G electronics. Some companies believe the counterfeiter have become so good, that they are not sure if some of their stock may be counterfeit.

Next, based on the text, provide your opinion of whether or not the government can use the Racketeer Influenced and Corrupt Organizations Act (RICO) or the Continuing Criminal Enterprise Statute (CCE) to combat global organized financial crimes like the sale of counterfeit merchandise.

The Racketeer Influenced and Corrupt Organizations Act (RICO) was establish back in 1970. The federal jurisdiction is possible under the RICO statue based on the criminal act. The RICO statue requires a criminal enterprise that affects interstate commerce. Interstate commerce would be any items purchased, commodities, people, money or goods that are moved through use of the interstate between states. There are approximately thirty-five key crime that fall under the RICO statue, E.G. Arson, Bribery, Counterfeiting, Kid Napping and Drug dealing.

Provide a rationale to support your response and respond to no less than one of your peers.

Even with the RICO statue or Continuing Criminal Enterprise Statute (CCE) the government may be able to make some progress, but in my opinion,  they will never get rid of counterfeit merchandise because it is such a lucrative business, and as long as it makes money there will always be people willing to take the risk.
