The Constitution and Established Convention

Introduction

The constitution is the guiding principle of a nation which contains best precedents that govern a state. Hence, a constitution is fundamental since it provides a practical framework for the Government and regulates the state power. Similarly, it defines the different sections of the government and their state roles. Hence, Hamilton (2019) suggests that the constitution is sturdy in a nation and outlines essential aspects in the country. The United States Constitution contains relevant laws that form the supreme power of the political community. Hence, the constitution is

the superior law of all other laws in the society, and the legislature, the executive, and the judicial systems are governed by the constitution. The federal constitution is part of the written constitution which is the fundamental law of the American people. Hence, this constitution establishes a direct relationship between the national government and formal power interactions

of the nation principal organs and institutions (Madison, 2019).

Moreover, The Federal Convention Constitution was drafted by seven articles that were founded the single US constitution. Apart from that, the Federal Convention Constitution has been amended by 27 documents over the years, and these changes have elapsed due to contractual agreements and adoption of new constitution principles. Hence, this research will explore how these articles and amendments affected the operations of the Federal Constitution in the United States by exploring their functions and limitations.

These amendments and articles provided a practical framework for the Federal and empowered the constitution to become better and address state issues. Similarly, the convention strengthened the government through these amendments and increased its powers. Hence, Barnett (2005) ascertains that the constitution became the guiding principle in the country. It controlled the nature of the government and its activities. Even more, these articles and amendments explored the specific arms of the government which explained their roles to the state. Besides, the federal system incorporated rules and regulations on foreign interactions with governments of other countries. Therefore, the amendments outlined the social responsibility and duties to foreign governments (Madison, 2019). This enabled the government to enter into long term productive relationships that helped build the state and improve the overall performance as a state. This constitution came into place in 1789 and has served the interest of the people ever since. Apart from that, the Federal Constitution has been affected by these changes by giving specific powers to the branches of the government. The executive handled most of the foreign matters while the legislature dealt with contractual agreements involving treaties.

The United States faced many challenges under the Article of Confederation since it was unable to pass laws. This affected its formation and implementation of the foreign policy due to its weak inability to enforce laws. Hence, the government couldn't meet the needs and interests of the people in the country (Hamilton, 2019). However, the United States found it challenging to pass the laws since the British came up with unfair practices that undermined the constitution like the debt agreements and confiscation of property. The amendments were essential in preventing such laws from taking action in the US and ensure that the British treated the American fairly as they exited their country.

Similarly, trade was controlled by the British, and they flooded the market with their products which made it difficult for American traders to benefit in their country. Hence, the Federal Constitution ensured that trade sanctions were imposed that promoted the local goods and increased trade opportunities for the manufacturers and importers in the country. Barnett (2005) affirms this resulted in the formation of some commercial treaties that empowered trade relations and allowed the United States to trade with Spain merchants. This change had to be implemented by the Federal Constitution amendment so that it can prevent the rise of revolutionary wars between the trading parties out of border conflicts. Furthermore, the constitution was split into three main parts that could help provide a system of check and balance and solve border conflicts with the partner countries. According to Madison (2019), the Federal Constitution outlined the roles of these branches with the legislature controlling the activities of the government and given superior power. The executive was to handle the paperwork for the assembly and deal with conflicting issues presented before the legislature.

The amendments and articles also provided for increased powers of the head of state. This enabled the president to be the commander in chief of the armed forces and directed matters of state concern (Hamilton, 2019). The amendments provide that the president was to address issues of national interest to the public and communicate the possible solution to the country. Apart from that, the President was to coordinate the activities of the branches of the government and ensures a smooth transition in the actions of the government in the three parts of the government. Also, the election of the president was looked into to ensure that an effective system was put in place to support credible election results. Madison (2019) confirms that there was a problem with the election system which was contributed by whether the legislature should elect the executive. Besides, there was information asymmetry since there were concerns that people would only vote for people from their state. Therefore, it was suggested that the state executive should be chosen by the governors of the rules. This resulted in the constitution amendment that formed the Electoral College that could handle elections. However, there was a concern since candidates feared that they couldn’t get sufficient votes from the Electoral College. Hence, the house was considered the best choice to select the president since it represents the majority opinion and promotes democracy. However, the small states felt like they were undermined by this rule and disadvantaged their countries (Barnett, 2005). To resolve this dispute, the constitution was amended such that those who did not have a majority place in the Electoral College and each state would vote as a bloc instead of individually. These changes were essential to ensure an effective electoral system was put in place to avoid conflict in leadership.

The significant amendments also ensured that the legislative power was reduced and the Congress was limited in its duties of implementing tax policies, war measures, the formation of treaties, and creating of post offices (Barnett, 2005). Hence, the powers were conferred to the constitution apart from those laws that required the execution of the other requirements. More so, the articles and amendments provided certain restrictions to the states so that they were governed correctly. These rules were outlined in the constitution and supervised the operation of the country. The states were prevented from entering into treaties and making their own money. These limitations were imposed to provide a check and balance system by the national government and ensure the states are well governed (Madison, 2019). This provided a stable relationship between the country and the federal government. Even more, the constitution ended dehumanizing acts of the slave trade and banned Congress from engaging in the practice. The amendments also removed tariffs on exports and quotas and promoted commercial activities in the country. Apart from that, the constitution amendments shortened the presidential term from seven to four years. The president could seek re-election after these years and get back into the office for the final time. The constitution also provided impeachment polices for a non-performing president. At this point, the powers of the Senate were reduced and such as the appointment of ambassadors and making of treaties.

The constitutional amendments also ensured that the bill of rights was implemented and people were protected in the state. This set to safeguard private citizens and government officials by promoting fair treatment of individuals in the nation (Barnett, 2005). The article also ensured that the state implemented measures that actively protected individuals at a time where national security was essential for the country. The amendment also included big government plans that such as Virginia, Hamilton, and New Jersey plans which also created the judicial system that was tasked with the responsibility of interpreting the law of the land. Notably, these plans were to provide more stable arms of the government and ensure that the government functions to provide the best service to the nation. According to Hamilton (2019), the constitutional amendment also advocated for better financial terms and policies that would support trade developments in society. This could be seen by the creation of financial institutions and stabilizing of the banking policy act that ensured people would become financially literate and increase investment opportunities in the country.

Conclusion

The constitution articles and amendment touch on significant areas that rectified the information in the federal convention constitution and ensured that it went through a transformation that marked substantial improvements. This improved its functions since it addressed essential issues in the country including the slave trade, border conflict, commercial terms and conditions that ensured the country was in the road map to progressive development. Similarly, the amendments provide that political matters were effectively handled in the country including presidential term and powers, the formation of political parties, and the powers vested to the congress and senate. It also looks at the roles and duties of the arms of the government and their developments over the years (Madison, 2019). These amendments also encompass the bill of rights that safeguards the state and its citizens and national officials. Above all, these articles and changes were essential for the development of a mature and functional constitution despite the challenges encountered in the process of building a comprehensive constitution.
